George Rovegno, Jr. <br />May 20, 1985 <br />Page 2 of 2 <br />Section 10.03, Subdivision 15 (C) was intended for lakeshore <br />lots that were adjacent to County roads along the rear property <br />line. The intent was to shield the homestead from the lights and <br />noises eminating from the use of the County road. The adjacent <br />lot owners' view of the lake would not be affected by the place­ <br />ment of a fence 6 feet in height along the rear/street lot line. <br />As we determined in the Hehl application, the lake viewing right <br />of a property owner on the opposite side of a County road, whose <br />lot lines did not run to the lakeshore had no legal claim or <br />recourse from the City. <br />You should be advised that staff always makes a site <br />inspection when a resident plans to erect a fence over 3 1/2 feet <br />along County roadways to assure that safety standards are upheld. <br />We do not ask that residents apply for a permit only that we <br />check the placement for sight problems. <br />As I interpret the Zoning Code, you may erect a fence within <br />your lakeshore yards as long as it does not exceed a height of 3 <br />^/2 feet above existing grade. I must ask that you remove the <br />newly erected fence within your lakeshore yard by Wednesday, May <br />29, 1985. <br />If you wish to appeal my interpretation of the code, please <br />file an appeals application with the City by May 24, 1985 so that <br />we can schedule your application before the Planning Commission <br />at their June 17, 1985 meeting. <br />George, please give me a call if you have any questions. <br />Sincerely, <br />Jeanne A.
