Said structure must meet the 50' setback from <br />the street lot line and the 26' setback from the drainageway <br />and the wetland areas. <br />3. No grading or filling will be allowed within the 26' <br />setback area. Applicant is to design a house that will <br />provide minimal impact on the existing elevations. Based on <br />staff's original memo, please note that the only excavations <br />to be allowed in the protected area will be the <br />modifications to the drainage ditch that intersects the <br />current building site. <br />4. Prior to drafting final building plans for the site, <br />future owner/developer shall be required to meet with the <br />Orono staff to review the special conditions of this <br />variance approval. <br />5. Any others deemed appropriate by the Planning <br />Commission. <br />Options of Action - <br />A) Denial. Please refer to the necessary findings in the <br />variance section of the zoning code; or <br />B) Approval of the lot area variance of Lyndon S. Bill Stubbs <br />requiring approval of a 23,522 s.f. or .53 acre variance <br />based on one or more of the following findings: <br />1. There is no additional dry buildable land adjacent <br />to the property. <br />2. Adequate and suitable area for on-site septic <br />development has been found in the upper elevations of <br />the property. <br />3. A house can be located on this .site meeting all <br />required setbacks from wetlands and street. <br />4. The location of the house will provide minimal <br />impact on existing residential development to the west. <br />5. Although the contiguus dry buildable envelope is <br />limited to 1.4 acres in area, the total property <br />consists of 20t acres.
