Contact MCES for further information and to receive a copy of the <br /> SAC Deferral Application form. <br /> 5.5.1.6.2 Rural Center SAC <br /> Pursuant to Council policy,Rural Centers may request to participate in the MDS. Such participation <br /> requires a higher Community-specific SAC rate and may also include payment deferral terms <br /> pursuant to a Community-specific agreement. <br /> 5.5.1.6.3 Region-Wide Economic Significance <br /> For issues of region-wide economic significance, SAC payments by Communities may be deferred, <br /> that is amortized over a period of up to ten years. Payments must include interest and a guarantee of <br /> payment by the Community.All terms included in the Master SAC Deferral Agreement noted in <br /> 5.5.1.6.1 will apply, with the exception that there is no SAC limit for the deferral. Contact MCES for <br /> further information and to receive a copy of the SAC Deferral Application. <br /> 5.5.1.7 Unpaid SAC Discoveries <br /> Communities should pay for the SAC liability to MCES for any discoveries of situations that did not, <br /> but should have paid and where the Site(s)do not qualify for the Non-Conforming Continuous <br /> Demand Credits. However, if collecting from the underlying responsible party is problematic,the <br /> Community may not be required to pay,based on a Community appeal approval(see section 5.2.1.9). <br /> MCES agreed with a 2012 SAC work group to limit its Community Review findings to three years, <br /> but may occasionally discover deficiencies outstanding longer than that even without a systematic <br /> review. In those situations,Communities will be advised of the situation.For the Non-Conforming <br /> Continuous Demand Credit to apply(for the unpaid demand),the Community must not have been <br /> notified at any time within the Continuous Demand period of unpaid SAC,representing capacity that <br /> is being used. When unpaid SAC for capacity being demanded is discovered by MCES more than <br /> three years after it should have been paid,but not long enough(e.g. 10 years)to qualify for Non- <br /> Conforming Continuous Demand Credit,the Community will be notified. The Community has the <br /> option to: i)pay the unpaid SAC to make the Site"whole"for its current Capacity Demand,or ii)not <br /> pay for the unpaid SAC but understand that there will be no potential Non-Conforming Continuous <br /> Demand Credit for the next change of use for this Site. <br /> 5.5.2 MCES SAC-A Form -Activity Summary Report <br /> The MCES SAC-A form is a summary of information from the supporting Activity Report forms. <br /> The MCES SAC-A RC form is the summary of information from the supporting Activity Report <br /> forms for Rural Centers use only. <br /> 5.5.2.1 Reporting Deadline <br /> SAC reports from Communities with a prior-year activity level exceeding 36 SAC units must be <br /> received by MCES (not simply post marked)within 30 days of the end of each month with the <br /> payment and corresponding forms. SAC reports from Communities with a prior-year activity level of <br /> no more than 36 SAC units and where the previous reports have been submitted by the report <br /> deadline,may report on a quarterly basis(but such reports must be received by MCES not simply <br /> post marked within 30 days of the end of each quarter) if the Community has received prior approval <br /> from MCES.(See Section 5.5.7) <br /> 5.5.2.2 No Activity <br /> If there is no SAC activity for the reporting period,the Community may write"no activity"on the <br /> form and mail, fax or email it to MCES. These reports must also be received by MCES within 30 <br /> days of the end of each month(or quarter). In all cases the report must state the name of the <br /> Page I34 <br />
