The Community is responsible for remitting SAC within 30 days of the end of the SAC reporting <br /> period in which the permit or business license was issued. <br /> To pay the current year's SAC rate,all Determination requests for MCES must be submitted with <br /> complete documentation no later than 10 MCES operational days before the end of the year in order <br /> for staff to have time to complete the Determination. The Community permit or license must be <br /> issued no later than December 31. (i.e.to pay the 2015 SAC rate,all Determination requests must be <br /> submitted no later than December 18,2015 and the Community permit or license must be issued no <br /> later than December 31,2015.) <br /> 5.5.1.2 Interest Charges <br /> At the discretion of the MCES Finance Director,MCES may add interest to any unpaid and <br /> delinquent SAC balances,as permitted by law. <br /> 5.5.1.3 Past Due SAC <br /> When unremitted SAC charges from prior years are discovered(e.g., in a Community Review),the <br /> Community must respond in writing within 60 days of the date of the Community Review letter if the <br /> Community can provide additional information or has a dispute with any of the findings in order to <br /> preserve the Community's legal rights. All undisputed portions of the Community Review findings <br /> must be paid within 60 days. In an extraordinary situation,the Community may request more time <br /> via a written appeal to the MCES Finance Director.Note: The liability for unpaid SAC is the <br /> Community's responsibility regardless of collection of Local SAC from property owners. <br /> 5.5.1.3.1 Good Faith Efforts and Use of Earlier SAC Rate <br /> Where the Community has acted in Good Faith in the opinion of the MCES Finance Director,MCES <br /> may accept a payment based on an earlier SAC rate and/or without interest accrual.The earlier SAC <br /> rate is that rate that was in effect at the time the SAC should have been submitted to MCES. <br /> Acceptance of the earlier rate is contingent on payment within 60 days from the date of the <br /> Community Review letter(or longer in extenuating circumstances, at the discretion of the MCES <br /> Finance Director). <br /> 5.5.1.4 Collection of Unpaid SAC <br /> MCES reserves the right to collect any unpaid SAC using any mechanisms provided by law, <br /> including the use of a Deficiency Levy as provided in Minnesota Statutes §473.521(4)which requires <br /> the County Auditor to levy an ad valorem tax on all properties within the Community. <br /> 5.5.1.5 Discount for Prompt Payment <br /> The Community is allowed to retain 1%of the net amount due for current SAC charges to MCES as <br /> a discount for prompt payment.However,the Community may not take this discount if all the <br /> reporting forms and payments are not remitted to MCES within 30 days of the end of the month(or <br /> quarter if quarterly reporting is approved by MCES). The prompt payment discount is not allowed to <br /> be taken on any adjustments or Temporary Capacity Charges made on the SAC report. (See section <br /> 5.5.2.1 for Reporting Deadline.) <br /> 5.5.1.6 Payment Deferrals (Pursuant to M.S. 473.517 subd. 6) <br /> 5.5.1.6.1 SAC Deferral Program <br /> MCES will make available to Communities a deferral program to provide the liquidity to facilitate a <br /> Community program for business deferrals(where the total Determination for the business is 25 or <br /> less SAC units). A Community must execute the standard Master SAC Deferral Agreement to <br /> participate in this program.
