July 20, 2020 page 27 <br />proposal as provided by section 82-144(a) and (b). Whenever the resolution of final subdivisionplat 1125 <br />approval requires changes, alterations or additions prior to final subdivisionplat certification, upon receipt 1126 <br />of all corrected documents, the zoning administrator City Administrator or designee shall refer the revised 1127 <br />documents to the affected staff for their review and recertification. 1128 <br />Sec. 82-174. - Official subdivisionplat certification. 1129 <br />Upon receipt of the final staff certifications, the city clerk shall determine that there has been final 1130 <br />staff approval and shall thereafter present the final subdivisionplat drawings and resolution of final 1131 <br />subdivisionplat or survey approval for the endorsement of the signature of the mayor, or the acting mayor 1132 <br />presiding in the absence of the mayor. Upon endorsement of the mayor, the city clerk shall attest to the 1133 <br />mayor's signature and the final city approval of the subdivisionplat by endorsing his signature and 1134 <br />affixing the seal of the city on each drawing and the resolution of final subdivisionplat approval. 1135 <br /> Sec. 82-175. - Recording of subdivisions. 1136 <br />(a) Completion of procedure. The subdivision procedure shall be completed by the city within 30 days 1137 <br />of the signing of the final plat or survey by the mayor and the city clerk. 1138 <br />(b) Survey or plat filed with county recorder's office. The city shall file the following documents with the 1139 <br />county recorder's office: 1140 <br />(1) One original copy of a certificate of survey in the case of class I subdivisions. 1141 <br />(2) The record plat drawings; one plastic film reproducible copy if abstract property; two plastic 1142 <br />film reproducible copies, if Torrens property. 1143 <br />(3) The resolution of final plat or survey approval; one original copy. 1144 <br />(4) One original copy of all required drainage, utility, road, access, open space conservation or other 1145 <br />easement. 1146 <br />(5) One original copy of any required quitclaim deed or warranty deed dedicating land to the city or 1147 <br />other governmental jurisdiction. 1148 <br />(6) One original copy of any private covenant or homeowners' association agreement required by 1149 <br />the city as a condition of final plat or survey approval. 1150 <br />(c) Copies to be returned to subdivider. The city shall return the following documents to the subdivider: 1151 <br />(1) One original copy of a certificate of survey. 1152 <br />(2) The record plat drawing; one hardshell mounted copy if the applicant has asked the surveyor for 1153 <br />an extra copy. Copies required by the city are set forth in section 82-142(c). 1154 <br />(3) The resolution of final plat or survey approval; one certified copy. 1155 <br />(4) One copy of all other easements, deeds, covenants or agreements filed by the city concurrent 1156 <br />with the filing of the final plat or survey. 1157 <br />(d) Failure to file subdivision. Should the city for any reason fail to file the certified plat, survey and/or 1158 <br />any of the required easements, deeds or agreements within the 30-day period, the subdivider may 1159 <br />individually file any or all such plats, surveys, easements, deeds or agreements if the filing occurs 1160 <br />within 180 days of the date of final plat or survey certification. 1161 <br />Sec. 82-176. - Final acceptance of improvements. 1162 <br />Final acceptance of all improvements and release of bondSecuritys shall be as and when set forth in 1163 <br />the subdivider's agreementdevelopment contract and section 82-171. Final acceptance of all public 1164 <br />improvements for which the city will thereafter be responsible shall be by separate resolution motion of 1165 <br />the city.
