<br />(7) To provide the most beneficial relationship between the uses of land and buildings and the 285
<br />circulation of traffic throughout the city, having particular regard to the avoidance of congestion 286
<br />in the streets and highways, and the pedestrian traffic movements appropriate to the various uses 287
<br />of land and buildings, and to provide for the proper location and width of streets and building 288
<br />lines. 289
<br />(8) To establish reasonable standards of design and procedures for subdivisions, in order to further 290
<br />the orderly layout and use of land; and to ensure proper legal descriptions and monumenting of 291
<br />subdivided land. 292
<br />(9) To ensure that public and private facilities are available and will have a sufficient capacity to 293
<br />serve the proposed subdivision. 294
<br />(10) To prevent the pollution of air, streams, ponds, wetlands, Lake Minnetonka and other bodies 295
<br />of water; to provide reasonable access to public waters; to assure the adequacy of drainage 296
<br />facilities; to safeguard the water table; and to encourage the wise use and management of natural 297
<br />resources throughout the city to prevent their misuse, abuse and overuse and in order to preserve 298
<br />the integrity, stability and beauty of the community and the value of the land. 299
<br />Sec. 82-6. - Authority. 300
<br />(a) Pursuant to the powers and jurisdictions vested through Minn. Stat. chs. 412 and 462 and other 301
<br />applicable laws, statutes, ordinances and regulations of the State, the city exercises the power of 302
<br />authority to review, approve and disapprove subdivisions of land within the corporate limits of the 303
<br />city. 304
<br />Sec. 82-7. - Minimum standards. 305
<br />In their interpretation and application, the provisions of this chapter shall be held to be the minimum 306
<br />requirements for the promotion of the public health, safety and general welfare and prevention of harm to 307
<br />the public health, safety and general welfare. 308
<br />Sec. 82-8. - Conflict with public provisions. 309
<br />This chapter is not intended to interfere with, abrogate, or annul any other provision of this Code, 310
<br />rule or regulations, statute, or other provision of law. Where any provision of this chapter imposes 311
<br />restrictions different from those imposed by any other provision of this chapter or any other provision of 312
<br />this Code, rule or regulation, statute or other provision of law, whichever provisions are more restrictive 313
<br />or impose higher standards shall control. 314
<br />Sec. 82-10. - Saving provision. 315
<br />This chapter shall not be construed as abating any action pending under or by virtue of prior existing 316
<br />subdivision regulations, or as discontinuing, abating, modifying or altering any penalty accruing or about 317
<br />to accrue, or as affecting the liability of any person, or as waiving any right of the city under any section 318
<br />or provision existing at the time of adoption of this chapter, or as vacating or annulling any rights 319
<br />obtained by any person, or as waiving any right of the city under any section or provision existing at the 320
<br />time of adoption of this chapter, or as vacating or annulling any rights obtained by any person, by lawful 321
<br />action of the city except as shall be expressly provided for in this chapter. 322
<br />Sec. 82-11. - Amendments of other provisions of this Code and regulations. 323
<br />(a) Whenever the provisions of this chapter refer to the Community Management Plan, official controls, 324
<br />or other provisions of this Code, codes, regulations or laws, it shall be deemed to refer to those official 325
<br />controls, plans, codes, provisions of this Code, and regulations as amended as of that point in time. In 326
<br />the event of an amendment during the application for a subdivision, that subdivision must meet the 327
<br />requirements of the amendment. 328
<br />(b) For the purpose of providing for the public health, safety and general welfare, the city may from time 329
<br />to time amend the provisions imposed by this chapter. 330
