July 20, 2020 page 9 <br />Sec. 82-12. - Jurisdiction. 331 <br />This chapter shall apply to all subdivisions of land located within the corporate limits of the city. 332 <br />Sec. 82-13. - Compliance. 333 <br /> (a) The subdivision of any lot or any parcel of land for the purpose of sale, transfer or lease by use of 334 <br />metes and bounds description, deed, contract for deed, purchase agreement, registered land survey or 335 <br />easement shall not be permitted except after full compliance with this chapter. 336 <br />b) All subdivisions shall be plated in accordance with the terms and conditions of this Chapter. 337 <br />(b) No building permit or certificate of occupancy shall be issued for any parcel or lot of land which was 338 <br />created by subdivision and not in conformity with the provisions of this chapter, and no excavation of 339 <br />land or construction of any public or private improvements shall take place or be commenced except 340 <br />in conformity with this chapter. 341 <br />(c) No subdivision shall be entitled to be recorded in the county recorder's office or have any validity 342 <br />until the subdivision has been prepared, approved and acknowledged in the manner prescribed by this 343 <br />chapter. The office of the county recorder shall not file or accept for filing any subdivision of land 344 <br />unless it is accompanied by a certified copy of the resolution of the city approving the subdivision. 345 <br />(d) Every person who violates any provision of this chapter when performing an act thereby prohibited 346 <br />or declared unlawful, or fails to act when such failure is thereby prohibited or declared unlawful, and 347 <br />upon conviction thereof, shall be punished as for a misdemeanor except as otherwise stated in specific 348 <br />provisions this chapter. 349 <br />(e) Appropriate actions and proceedings may be taken by law or in equity to prevent any violation of this 350 <br />chapter to prevent unlawful construction, to recover damages, including attorney's fees, to restrain, 351 <br />correct or abate a violation, or to prevent illegal occupancy of a building, structure or premises, and 352 <br />these remedies shall be in addition to the penalties describe above and provided in State statutes. 353 <br /> 354 <br />State Law reference— Authority to require platting, Minn. Stat. § 462.358, subd. 4b. 356 <br /> 357 <br /> 358 <br />Sec. 82-16. - Conditions. 359 <br />Regulation of the subdivision of land and the attachment of reasonable conditions to the subdivision 360 <br />of land is an exercise of valid police power delegated by the State to this city. The subdivider has the duty 361 <br />of compliance with reasonable conditions laid down by the city for design, dedication, improvement and 362 <br />restrictive use of the land so as to conform to the physical and economical development of the city and the 363 <br />city's Community Management Plan and to the safety and general welfare of the future lot owners in the 364 <br />subdivision and of the community at large. 365 <br />Secs. 82-17—82-45. - Reserved. 366 <br /> 367 <br />ARTICLE II. - ADMINISTRATION AND ENFORCEMENT[2] 368 <br /> 369 <br />Cross reference— Administration, ch. 2. 370 <br />Sec. 82-46. - Enforcement. 371 <br />It shall be the duty of the City Administrator or designee to enforce this chapter and to bring to the 372 <br />attention of the city attorney any violations or lack of compliance with this chapter. 373
