<br />Subdivider means any person who: 205
<br />(1) Has an interest in land, who causes it, directly or indirectly to be divided into a subdivision; 206
<br />(2) Directly or indirectly sells, leases or develops, or advertises for sale, lease or development, any 207
<br />interest, lot, parcel, site, unit or plot in a subdivision; 208
<br />(3) Engages directly or through an agent in the business of selling, leasing, developing or offering 209
<br />for sale, lease or development a subdivision or any interest, lot, parcel, site, unit or plot in a 210
<br />subdivision; or 211
<br />(4) Is directly or indirectly controlled by or under direct or indirect common control with any of the 212
<br />foregoing. 213
<br />Subdivider's agent means any person who represents or acts for or on behalf of a subdivider in 214
<br />selling, leasing or developing, or offering to sell, lease or develop, any interest, lot, parcel, unit, site or 215
<br />plot in a subdivision. 216
<br />Subdivision means the separation of an area, parcel or tract of land under single ownership into two 217
<br />or more parcels, tracts, lots or long-term leasehold interests, where the creation of the leasehold interest 218
<br />necessitates the creation of streets, roads or alleys, for residential, commercial, industrial or other use or 219
<br />any combination of such uses, except those separations: 220
<br />(1) In which all the resulting parcels, tracts, lots or interests will be 20 acres or larger in size and 221
<br />500 feet in width for residential uses and five acres or larger in size for commercial and industrial 222
<br />uses. 223
<br />(2) Creating cemetery lots. 224
<br />(3) Resulting from court orders, or the adjustment of a lot line by the relocation of a common 225
<br />boundaryas long as each of the resulting lots meets the requirements of chapter 78. 226

<br />Surface water management plan means a compilation of policy statements, goals, standards, maps 228
<br />and action programs for guiding the future hydrological and hydraulic development of the watersheds and 229
<br />subwatersheds, water storage areas, drainageways, floodways and filtration systems of the city to control 230
<br />surface water runoff, flood hazards, flood damage and general water quality within the city and its 231
<br />environs, including lakes, streams, wetlands, marshes, natural watercourses and storm sewer systems or 232
<br />facilities. 233
<br />Temporary improvement means improvements built and maintained by a subdivider during 234
<br />construction of the subdivision. 235
<br />Tract and subject tract mean the parcel of land comprising all the contiguous land owned or 236
<br />controlled by the subdivider and included in whole or in part in the subdivision. 237
<br />Transportation plan means a compilation of policy statements, goals, standards, maps and action 238
<br />programs for guiding the future development of the various modes of transportation of the city and its 239
<br />environs, such as streets and highways, public transit, railroads, air transportation, trucking and water 240
<br />transportation; and includes a major thoroughfare plan. 241
