Staff finds that the thresholds established in the Zoning Code for requiring a land alteration CUP <br /> are not surpassed with this proposal, hence no sucll CUP is required. However, if the house is required to <br /> be relocated, a revised grading pl�n should be required to confirm that the 500 c.y. grading tlu•eshold is not <br /> surpassed and that buildin� height does not become an issue. Council sllould review the landscape plau <br /> with the affected neighbors to determine whether they find it satisfactory. Council should detei•mine <br /> wheiher an advisory regarding rental use of the studio space is warranted. <br /> Background <br /> This application was before the Plaruiing Commission in September, at which time PC voted <br /> 4-3 on a motion to recouunend approval of a lot width variance but deny a CUP for grading <br /> in excess of 500 cubic yards to create a walkout sih.iation. That reconunendation went <br /> forward to the Council on September 26. Discussion ensued regarding the impact of the <br /> house on the surrounding neighborhood as currently designed and located, and the <br /> application was tabled by Council. <br /> A revised plan with a smaller house, relocated fiirther forward on the lot in line with the <br /> neighboring home to the east, was submitted and subsequently reviewed by Couucil on <br /> October 10. Council heard from neighbors who generally supported the coucept of moving <br /> the house forward, where it would not overwhelm the neighbors' open space. Council then <br /> referred the revised plans to the Plaiuling Coinuiission for review at the Noveinber PC <br /> meeting. Applicant concluded he needed additional time to refine his plans and extended the <br /> review period by 6 months. He then provided a set of plans which were reviewed by the <br /> Plaruung Coi2�unission and recorrunended for approval by a vote of 6-0 on February 20, 2006, <br /> subject to submittal of a landscape plan and saving as inany remaining trees as possible. The <br /> new plan has the following characteristics: <br /> - House footprint..................................4,635 s.f. <br /> - West side setback...................................30' <br /> - East side setback....................................30' <br /> - West side driveway setback........................20' <br /> - Driveway access..............................Heritage Drive only <br /> - Cut/fill balance...........................365 cubic yards to be ex�orted <br /> - Relocation forward allows walkout with cuts/fills generally in the <br /> range of 1'-4' depth <br /> - City Engineer has approved grading aud drainage plans <br /> - Retaitung wall along west side of driveway ranges from 0'-4' high, <br /> 100' long, 20' fi•om side lot line <br /> - House plans indicate height meets 30' limit <br />
