Van Zomeren indicated that preservation of a tree is not considered <br /> a hardship in the State guidelines. In order for this to occur, other regulations need to be <br /> in effect. <br /> Wilson said she would favor replac�ment of 8"+trees. <br /> Beal said a policy is necessary in order to preserve open space. <br /> Wilsan suggested beginning at the development level. She said she feels she represents <br /> the feelings of many of the residents of Orono. <br /> Beal asked if the distinction can be made between private property owners and <br /> development. Van Zomeren said yes but noted the problems that arise when new owners <br /> have the ability to do what they want after the development has occurred. <br /> 1VIcDermott said he feels if rules are in place, the new residents would be aware of them. <br /> It may create a problem with current residents. McDermott suggested a possible varianc� <br /> for tree removal. <br /> Wilson said it would be difficult to police and was concerned over what statement such a <br /> variance woul� make about what the City is all about. <br /> Beal indicated that the cities he has reviewed seem to have all gone thraugh this same <br /> discussion and process and determined that there is a need for such an ordinance. The <br /> amount af replacement and development varies amongst the cities. <br /> Wilson voiced concern with #3 on the check list regarding site inspection. Beal explained <br /> that this referred to pre-construction. <br /> Van Zomeren questioned the additional cost of surveying the trees. Surveys currently <br /> show large trees or stands. Beal suggested the surveys show significant trees. Van <br /> Zomeren asked how a stand of trees would be designated. McDermott said they could be <br /> indicated by a grouping noting surveys identify masses of trees. Wilson not�d it could <br /> become a matter af opinion of whether a stand of trees is considered significant. <br /> McDermott said the particulars could be determined by Staff or Planning Commission. <br /> Van Zomeren nated that the applications reviewed by the Planning Commission involve <br /> variances. Permits are obtained from the City daily through the Building Official. It <br /> would be difficult to project the additional work load such a policy would have on City <br /> staff. <br /> 1U <br />
