Since this would <br />fall under the provision that the Planning <br />Commission has recommended to the Council called <br />Lot of Record, a variance from the size requirement <br />is reasonable. 1,4r. Lundgren wants to place the <br />house 63' from the lake because the utility <br />easement running through the property would prevent <br />him from being exactly 75' from the lake. If the <br />house was located on the northwest side of the <br />utility easement, the home would be in excess of <br />100' from the lake. <br />Van Nest moved, Curtis seconded, that the variance <br />from the 75' lake setback requirement be denied <br />since there is not sufficient hardship and due ,to <br />'-he fact that they can build on Tract B of the <br />RLS; but a variance for the lot size requirement <br />should be granted since it falls within the <br />proposed ordinance referred to as Lot of Record. <br />%lotion, Ayes (6) - Nays (0). <br />The Pohle application involves two variances. <br />1) a variance from the setback requirement for <br />accessory structure, and 2). a variance from the <br />amount of, hardcover allowed within 5001 of the <br />lakeshore. 14r. Pohle has requested permission <br />to construct a tennis court which would be three <br />feet from his side lot lines. The ordinance <br />requires a 10' setback. In addition, the court <br />would add additional hardcover bringing the total <br />amount of hardcover from the entire lot to 38.6 %. <br />The ordinance regulating the amount of hardcover <br />near the lake stipulates that there shall be no <br />more than 30% hardcover. <br />Gasch moved, Guthrie seconded, to deny the Pohle <br />request for a variance because it exceeds the <br />amount of hardcover that the ordinance allows. <br />klotion, Ayes (5) - Nays (1). Kullberg Nay. <br />,mendmente Kullberg moved, Curtis seconded, to <br />deny the request because the 10' sideyard <br />setback requirement was not met.
