MINUTES OF A REGULAR MEETING HELD JUNE 17, 1974 <br />proposed for two acre minimum and the lot, as <br />indicated by the survey, meets all the standards <br />required in the new zoning ordinance. After all <br />people present were afforded an opportunity to <br />be heard, Chairman Van Nest closed the public <br />hearing at 7:55 P.M. <br />Gasch moved, Kullberg seconded, to approve the <br />subdivision as is shown on the survey, conditioned <br />on the payment of the 5% park fee and completion <br />of a percolation test. Motion, Ayes (6) - Nays (0). <br />Page 2 <br />PUBLIC HEARING <br />(Continued) <br />Dunn <br />Chairman Van Nest opened a public hearing regard- PUBLIC HEARING <br />ing a subdivision of one acre from a 16 -acre tract SUBDIVISION & VARIANCE <br />and a variance which would allow the creation of 4080 Bayside Road <br />the one -acre lot in a five -acre zone at 8 :06 P.M. <br />The Zoning Administrator presented the Notice of <br />Public Hearing, the Certificate of Nailing, and <br />the Affidavit of Publication. The Zoning Administrator <br />explained that the application for a variance was <br />based on the fact that the existing home on the <br />property was isolated by a ravine on the north and <br />a steep slope on the east. In order to grant a <br />variance from the zoning ordinance, the Planning <br />Commission has to find that a hardship exists and <br />it is the feeling of the petitioner that the ravine <br />and steep slope constitute such a hardship. The <br />2onincj Administrator agreed that the ravine to <br />the north did constitute a hardship but the slope <br />to the east of the home would not logically tie <br />in with any lot whether it is with the existing <br />home or with some future home site on the lower <br />ground. Therefore, any lot that is created along <br />Bayside Road, including the existing home, should <br />be more than the proposed one acre and should follow <br />the ravine and the bottom of the hill east of the <br />house assuming that this will not interfere with <br />access to the remainder of the Berg property. <br />Mr. Fred Poisson spoke in opposition to the request <br />and claimed that the variance will mean that this <br />property, owned by Dr. Berg, will have four <br />residences rather than three and the intent of <br />the five -acre zone was to maintain a low density <br />in areas that do not have public utilities. In <br />addition, this is part of a drainage way, and <br />any access to the rear of the property would be <br />a Droblem because of the ravine and the severe <br />drop in elevation from Bayside Road. After all <br />the people present were afforded an opportunity <br />to be heard, the public hearing was closed by <br />Chairman Van Nest at 8 :24 P.M. <br />;hairrman Van Nest informed the petitioner that <br />the Planning Commission could not approve the <br />request as presented by Dr. Berg. Van Nest <br />suggested that Dr. Berg withdraw his application, <br />(Continued) <br />
