' B. On the basis of the actual cost of materials and labor on the job site, <br /> a maximum of 10% on materials and 10% on labor for Contractor's <br /> ' overhead and profit, which shall include the cost of Insurance and <br /> field supervision. If the work is done by a subcontractor, the Prime <br /> Contractor may add not more than 10% for his general overhead and <br /> ' profit. In preparing the Supplemental Agreement, the following <br /> document must be provided: <br /> 1 1. A breakdown of material and an hourly breakdown of labor <br /> must be shown on each supplement submitted. <br /> ' 2. All supporting documents must be incorporated by reference <br /> on each supplement. <br /> ' 3. Corrections must be dated and initialed by the Contractor and <br /> Project Manager. <br /> 4. The contract summary must be complete, and adequate <br /> justification and supporting documentation must be included <br /> with each supplement. <br /> 8. PAYMENTS AND COMPLETION <br /> ' Article 9, "Payment and Completion" is supplemented by the following: <br /> ' Unless otherwise provided in the specifications, Temple Israel in making partial <br /> payments, will retain ten (10) percent of the duly approved value of the work <br /> performed under contract as of the date of the application for payment until final <br /> completion and acceptance of all work covered by the Contract. <br /> ' Payment request will be made on AIA forms G702-1978 and G703-1978. Request <br /> for payments will be given to Project Manager for his review and approval. <br /> ' Temple Israel may at its discretion, withhold final payment until the Contractor has <br /> filed with the Temple Israel an affidavit showing evidence that all claims against him <br /> ' by reason of the Contract have been paid or satisfactorily secured. In case such <br /> evidence is not furnished, Temple Israel may retain from any amount due said <br /> Contractor sums sufficient to cover all claims unpaid. <br /> All Contractors and Subcontractors shall comply with the provisions of Minnesota <br /> Statutes 290.92 relative to the withholding of Income Tax on wages and no final <br /> ' settlement with any Contractor shall be made until said Contractor has offered <br /> satisfactory proof that he has complied with the provision of the Withholding Section <br /> of the Statute: <br /> ' 11 <br />
