REQUEST FOR COUNCIL ACTION <br /> DATE: January 11, 2017 <br /> ITEM NO:6 <br /> Department Approval: Administrator Reviewed: Agenda Section: <br /> Name Jeremy Barnhart 27144 Planning Department Report <br /> Title Community Development Director <br /> Item Description: Jake Barkley,430 Old Crystal Bay Road, Determination of Use <br /> Application Summary <br /> Jake Barkley is considering purchase of 430 Old Crystal Bay Road to construct an industrial building <br /> which would house his business that takes in large limestone blocks or slabs and cuts them using large <br /> saws. The finished stone is used in landscaping and building architecture. <br /> On site activities include the loading and unloading of the large stone blocks using end loaders and <br /> trucks. While the activity occurs inside the building, occasionally,the door will be open to accept new <br /> material and discharge the finished product. <br /> The proposed use could be considered a permitted use in the industrial zoning district: <br /> Sec. 78-822. -Permitted uses. <br /> (a) General conditions. The following are permitted uses within the I-Industrial District. <br /> (1) Automobile and truck painting, major repair, body and fender work, upholstering tire <br /> recapping and wholesale/fleet sales, but shall not include retail when within a completely <br /> enclosed building. The storage of automobiles or trucks in process of repair shall be within a <br /> fenced area. <br /> (2) Cabinet and carpentry shops, lumberyards millworks, electrical, plumbing and heating and <br /> air conditioning shop. <br /> (3) Manufacturing or assembly of a wide variety of products that produces no exterior noise, <br /> glare,fumes, obnoxious products, byproducts or wastes, or creates other objectionable <br /> impact on the environment. These shall include the following: <br /> a. Manufacturing, compounding, assembly, packaging, treatment or storage of products <br /> and materials. Expressly prohibited activities shall include: the stockpiling and recycling <br /> of aggregate materials or supplies of more than 25 cubic yards. <br /> When a use is not expressly listed in the zoning ordinance, the Zoning Administrator is charged with <br /> determining the use. The Zoning Administrator may refer the item to the Council for final <br /> determination: <br /> Sec. 78-821 - Purpose and review of building permit applications. <br /> (c) Determination of use. Whenever a proposed use is not clearly defined as to its inclusion in <br /> the list of permitted, conditional, or accessory uses in this district,the zoning administrator <br /> shall make a determination. The zoning administrator may refer the item to the city council <br /> for a final determination, if desired. <br />
