The purpose of this action item is to review the Wellhead protection ordinance <br />(Code Section 14-142) for possible amendment or repeal. <br />2. Background. In October of 2013 the City adopted our Wellhead Protection Plan (WHPP). <br />The WHPP is a requirement of the Minnesota Department of Health under Minnesota State <br />Statutes 103I sub5 parts 4720.5100-4720.5590. Wellhead Protection is a method of preventing <br />contamination of a public water supply well by effectively managing potential contaminant <br />sources in the area which contributes water to a public water supply well. Measure 133-2 of the <br />WHPP plan reads: The City Council will pass and ordinance requiring hookup to City water <br />where available. This will reduce the likely hood that pumping of other wells will impact <br />contaminant movement to the City wells. <br />In February 2015 the City Council adopted Ordinance No 135 creating Code Section 14-142 <br />for Protecting the City's Wellheads by Prohibiting New Private Wells Where Public Water <br />Supply is Available. <br />3. Ordinance. <br />14-142 Wellhead Protection - New Private Wells Prohibited. <br />(A) The owners of all buildings where a public water supply is available, or becomes <br />available, shall connect the buildings to the public water supply, subject to the following <br />conditions: <br />1. A private property with a functioning well will not be required to be connected to <br />the city water until the well becomes nonfunctioning or the building undergoes major <br />remodeling resulting in an increase in water use that exceeds the capacity of the well. <br />2. Where it is not feasible to connect to a public water supply, or if private on-site <br />water supplementation is required as determined by the City of Orono, a well may be drilled <br />in accordance with the specifications and provisions of the Minnesota Department of Health, <br />Water Well Construction Code. <br />(B) At the time connection to the public water supply is completed, all existing private wells <br />no longer in use shall be sealed by a licensed well contractor according to the Rules of the <br />Minnesota Department of Health. <br />
