CITY OF ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. <br />M -F: Normal construction hours, 7:00 a.m. to 8:00 p.m. <br />Saturday: 8:00 a.m. to Noon only, and limited to low-volume in -out activity, no heavy <br />hauling <br />Sunday: No activity whatsoever on Sundays <br />5. Applicant shall obtain all appropriate required permits from Hennepin County, Minnehaha <br />Creek Watershed District, MPCA, and any other agencies or governing authorities as may <br />be required for activities on the site. Operation of the use shall meet MPCA guidelines re: <br />Polycyclic Aromatic Hydrocarbons (PAHs) and provide dust control from construction <br />and recycling activities. All Federal, State, County and City air, water and noise quality <br />standards must be met. <br />6. Construction of a proposed permanent screening berm along the south and southwesterly <br />boundaries of the site shall not commence until the Applicant has obtained conditional <br />use permit approval from the City of Orono. <br />7. All exterior lighting associated with the operation shall be so directed so as not to cast <br />glare toward or onto the public right-of-way or neighboring residential uses or districts. <br />8. This site shall not be used for materials recycling/crushing/grinding operation when other <br />sites within the City of Orono are in use for the same activity. <br />9. An ongoing 6 -month review of the interim use permit shall be conducted to determine <br />whether the use remains acceptable during the duration of the Wayzata Boulevard <br />improvement project. <br />10. By accepting this Interim Use Permit, the Applicant agrees: <br />a. to allow the City all reasonable access to the site to perform inspections as the City <br />deems necessary to ensure compliance with the conditions herein; <br />b. to reimburse the City for any costs incurred as a result of enforcing the IUP following <br />violation of any condition of the permit; <br />c. to hold the City harmless for all claims or causes of action that may result from the <br />granting of the IUP. <br />d. to indemnify the City for all costs, damages or expenses, including but not limited to <br />attorneys' fees that the City may pay or incur in consequence of such claims. <br />11. Restoration. The site shall be restored no later than one (1) year after the road project has <br />been complete. Restoration shall include regrading as necessary to restore pre-existing <br />drainage and runoff patterns, and revegetation of the site with suitable ground cover <br />materials. Applicant shall post restoration security with the City in the amount of $10,000 <br />to ensure restoration occurs. <br />Page 7 of 9 <br />
