CITY OF ORONO RESOLUTION OF THE CITY COUNCIL NO. M -F: Normal construction hours, 7:00 a.m. to 8:00 p.m. Saturday: 8:00 a.m. to Noon only, and limited to low-volume in -out activity, no heavy hauling Sunday: No activity whatsoever on Sundays 5. Applicant shall obtain all appropriate required permits from Hennepin County, Minnehaha Creek Watershed District, MPCA, and any other agencies or governing authorities as may be required for activities on the site. Operation of the use shall meet MPCA guidelines re: Polycyclic Aromatic Hydrocarbons (PAHs) and provide dust control from construction and recycling activities. All Federal, State, County and City air, water and noise quality standards must be met. 6. Construction of a proposed permanent screening berm along the south and southwesterly boundaries of the site shall not commence until the Applicant has obtained conditional use permit approval from the City of Orono. 7. All exterior lighting associated with the operation shall be so directed so as not to cast glare toward or onto the public right-of-way or neighboring residential uses or districts. 8. This site shall not be used for materials recycling/crushing/grinding operation when other sites within the City of Orono are in use for the same activity. 9. An ongoing 6 -month review of the interim use permit shall be conducted to determine whether the use remains acceptable during the duration of the Wayzata Boulevard improvement project. 10. By accepting this Interim Use Permit, the Applicant agrees: a. to allow the City all reasonable access to the site to perform inspections as the City deems necessary to ensure compliance with the conditions herein; b. to reimburse the City for any costs incurred as a result of enforcing the IUP following violation of any condition of the permit; c. to hold the City harmless for all claims or causes of action that may result from the granting of the IUP. d. to indemnify the City for all costs, damages or expenses, including but not limited to attorneys' fees that the City may pay or incur in consequence of such claims. 11. Restoration. The site shall be restored no later than one (1) year after the road project has been complete. Restoration shall include regrading as necessary to restore pre-existing drainage and runoff patterns, and revegetation of the site with suitable ground cover materials. Applicant shall post restoration security with the City in the amount of $10,000 to ensure restoration occurs. Page 7 of 9
