CITY OF ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. <br />to the remote location should have minimal impact on neighboring uses. The <br />materials storage and recycling operation will be subject to MCWD and <br />APDES permits to manage runoff. The use of state-of-the-art materials <br />grinding and crushing equipment to minimize dust, noise etc. has been <br />proposed by the applicant. The potential impacts of PAH emissions to the air <br />or water as suggested by a neighboring property owner are beyond the scope <br />of City regulations. Such impacts, if any, are expected to be under thepurview <br />of MPCA regulatory authority. <br />(14) All exterior lighting shall be so directed so as not to cast glare toward or <br />onto the public right-of-way or neighboring residential uses or districts. This <br />will be included in the IUP as a condition of approval. <br />(15) Not detrimental to the public health, public safety, or general welfare. <br />Potential detrimental impacts to the public health, safety and welfare by the <br />temporary use of the property as proposed are not anticipated. <br />15. The City Council has considered this application including the findings and <br />recommendation of the Planning Commission, reports by City staff, comments by <br />the Applicants and the public, and the effect of the proposed interim use permit on <br />the health, safety and welfare of the community. <br />16. The City Council finds that the Applicants' request would be in keeping with the <br />spirit and intent of the Zoning Code and Comprehensive Plan of the City. <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon one or more of the above findings, the Orono City Council hereby grants an <br />Interim Use Permit pursuant to Orono Municipal Zoning Code Sections 78-421 to allow the <br />operation of a temporary facility for construction staging, materials and equipment storage, and <br />materials recycling use on the Property, subject to the following conditions: <br />1. This 1UP is for temporary use of the Property in accordance with the site layout submitted <br />by the applicant, attached hereto as Exhibit B. The processing equipment must be located <br />so as to minimize its effect on surrounding property owners. <br />2. Use of the site shall be limited solely to activities related to the Wayzata Boulevard <br />improvement project and may not be used to support other road construction or similar <br />projects outside the corporate limits of the City of Orono or the City of Long Lake. The <br />processing equipment may only be on the property for the duration of the project. <br />3. Use of the site shall be subject to Orono Code standards with regard to noise, lighting, dust <br />control, street maintenance, etc. Hours of operation to be limited as follows: <br />Page 6 of 9 <br />
