CITY OF ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. <br />12. Termination. This Interim Use Permit will terminate on the occurrence of any of the <br />following events, whichever occurs first: <br />a. Completion of the Wayzata Boulevard improvements (Phases 1, 11 and III) or three <br />years from the date of this Resolution, whichever occurs first. <br />b. Upon violation of conditions under which this permit was issued. If any conditions <br />of this 11UP are violated, the City Council may revoke it on fourteen (14) days' notice <br />to the Applicant, who may request a hearing before the Council with seven (7) days <br />of the City mailing notice to the Applicant. If the Applicant fails to request a hearing <br />within said seven days, his right to a hearing is waived. The City Council may revoke <br />this 1UP if the property is found to be in violation of the conditions listed in this <br />interim use permit. <br />c. Upon a change in the zoning regulations, which renders the interim use <br />nonconforming. <br />d. Upon redevelopment of the Property for residential use. <br />e. Upon 30 days' notice to the applicant and after a public hearing the City may revoke <br />the permit without any cause or violation demonstrated. <br />13. Authorities granted by this resolution run with the applicant and are not transferable <br />except by written permission of the City Council, <br />14. The undersigned Applicant has read, understands and hereby agrees to the terms of this <br />resolution, and hereby agree to the recording of this resolution in the chain of title of the <br />Property. <br />Adopted by the Orono City Council on the day of 52017. <br />ATTEST: <br />Anna Carlson, City Clerk Dennis Walsh, Mayor <br />Applicant <br />Page 8 of 9 <br />
