CITY OF ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. <br />11. The submitted site plan indicates a proposed visual and noise -screening berm along <br />the west and south boundaries of the site. Applicant is working with the MPCA to <br />establish parameters and obtain permits for this berm, which will become an <br />amenity for future residential development. The City will require a grading plan <br />be approved for this, and it will require a Conditional Use Permit based on the <br />volume of permanent fill material. <br />12. The applicants' narrative suggests that this site might be used as a recycling yard <br />for projects other than just the Wayzata Boulevard improvements. The Orono <br />Planning Commission reviewed this application at its March 20th and April 17 1h <br />meetings, and recommended that use of the site should be limited solely to activities <br />related to the Wayzata Boulevard improvement project and should not be used to <br />support other projects. The Orono City Council concurs. <br />13. Site physical and location factors which support the intended temporary use include <br />that it is open and relatively flat; it has good accessibility to Wayzata Boulevard <br />and will not result in traffic impacts to residential streets; it is large enough for the <br />intended activities; and it is relatively remote from nearby residential development <br />(700' to home to the NE across Wayzata Blvd., 1000'+ from any homes to the SW <br />across the freeway), so that the potential negative impacts such as noise, vibration, <br />glare, dust, etc. should be minimal as compared to most other locations within the <br />Wayzata Boulevard corridor. <br />14. Review per Zoning Code Section 78-916. The Interim Use standards require that <br />an IUP request be considered with respect to the Conditional Use Permit (CUP) <br />standards of Zoning Code Section 78-916. Following is an analysis of the requested <br />IUP in relation to those standards. Council's findings following each criterion are <br />shown in bold italics. <br />Conditional Use Permit Analysis <br />Conditional use permit approval shall be granted only when the following <br />criteria are met: <br />(1) The proposed Interim Use is consistent with the Community Management <br />Plan(CMP). The proposed temporary use is commerciallindustrial in nature <br />and such use is consistent with the CMP guiding for this residential <br />neighborhood subject to the Interim Use provisions of the Zoning Code and <br />of the RR-lB Zoning District. <br />(2) The proposed use is compliant with the zoning code, including any <br />conditions imposed on specific uses as required by Article V, Division 3 of the <br />City Code. The proposed temporary use is compliant with the zoning <br />standards established for this interim use. Article V Division 3 does not <br />address the specific construction staging use proposed. <br />Page 3 of 9 <br />
