Purpose. The purpose of this action item is to review a draft resolution for approval of an Interim <br />Use Permit for the property at 3245 Wayzata Boulevard to allow temporary staging of construction <br />activities associated with Hennepin County's CSAH 112 (Wayzata Boulevard) Improvement Project. <br />2. Application Deadline. A decision must be made by June 27, 2017. The timeline has been <br />extended once previously. If the applicant has not waived the 60 day rule, or the Council has not <br />made a decision by June 27, the project is approved. <br />3. Background. This item was discussed by the City Council at their meeting on May 8h and May <br />22 nd , at which time action was tabled pending full council review. <br />The applicants have submitted an application requesting an Interim Use Pen -nit for temporary use of <br />the property at 3245 Wayzata Boulevard for staging of construction activities associated with the <br />Wayzata Boulevard Improvement Project which commenced in April. On May 8th the Council <br />adopted an ordinance amending the zoning code by establishing parameters for Interim Uses <br />generally, and a second ordinance that allows for "Temporaryfacilities for construction staging, <br />materials and equipment storage, and materials recycling, when suchfacilities are associated with <br />adjacent public road construction or reconstruction projects in the City of Orono - as an Interim Use <br />within the RR- I B zoning District. <br />U <br />pdate: Current Status of 365 Old Crystal Bay Road Site Use. The contractor for the Hennepin <br />County Wayzata Boulevard improvement project obtained a permit from MnDOT to use a site at 365 <br />Old Crystal Bay Road for the staging and recycling operation for Phase 1 (2017-2018) of the highway <br />improvements. As the project began, the contractor did obtain permission from Hennepin County to <br />recycle materials within the actual Wayzata Boulevard right-of-way, reducing the potential impacts <br />of use of the Old Crystal Bay Road site. This was discussed at the May 8 council meeting. <br />However, on Tuesday, May 9th at the weekly construction meeting staff learned that the contractor <br />still intends to use the 365 OCB Road site for materials storage and recycling/grinding later this <br />summer. Staff and City Attorney then followed up with the state permitting authorities, and on <br />Wednesday May I oth the contractor was advised by staff that the City will not allow this activity, and <br />gave them a window in which to remove the existing topsoil stockpiled at the site. <br />4. Review of IUP for 3245 Wayzata Boulevard. The applicants have requested that their <br />application for IUP approval continue to be reviewed, as they would like to be prepared for use of the <br />Eisinger site for later Phases of the Improvement Project. If an IUP is approved, it would seem <br />reasonable to allow the use for the remainder of Phase I. <br />On May 8th Council directed that staff prepare a draft resolution for approval of an Interim Use <br />Permit for 3245 Wayzata Boulevard. A draft resolution is attached, incorporating recommendations <br />of the Planning Commission and staff, as well as additional conditions suggested by the Council on <br />May 8th. Council should carefully review the draft language of the resolution, and consider whether <br />it reflects Council's intent. <br />
