AGENDAITEM <br />The IUP ordinance requires three specific pieces of information to be submitted as part of the <br />application process, as follows: <br />(a) Written documentation that includes a complete description of the use, schedule for <br />commencement and tennination of the use, hours and dates of operation and anticipated <br />employment. <br />(b) Any special studies requested by the City when there is evidence that the proposed use may <br />negatively impact public infrastructure, the environment or adjacent land uses. These studies <br />may examine the impacts on such things as traffic, environment, wetlands and utilities. <br />(c) Evidence of approval or preliminary approval from all other agencies with jurisdiction over <br />elements of the use. <br />As noted in the May 8th staff memo, Items (a) and (c) have been submitted relative to the use for <br />future phases, but not specifically for Phase I of the Wayzata Boulevard improvements. With regard <br />to item (b), the City has not requested any special studies to date. Council should discuss whether any <br />such studies or further information should be requested with regard to use of the site for Phase I in <br />2017-2018 as well as future Phases. <br />5. Staff Recommendation. Acknowledging that Interim Use Permits are new ground for the City <br />of Orono, staff recommends acting cautiously on this request. it can be argued that the proposed <br />operation is simply the same activity that the City engages in every time we rebuild a City road, but <br />on a larger scale. At the same time, there has been some level of public opposition to this request <br />from adjacent and nearby landowners. <br />Council should review the information provided to date, and discuss with the applicants items of note <br />as well as any additional concerns. The Council should consider adopting or amending the draft <br />resolution attached. <br />COUNCIL ACTION REQUESTED <br />Review the proposed interim use as presented. <br />- If Council determines that an IUP for this site should be granted, review the draft resolution, <br />make any appropriate revisions, and adopt the resolution. <br />- If Council determines that more information is required, table and provide staff and applicant <br />with specific direction. <br />- If Council determines that an 1UP should not be issued for this site, then direct staff to draft a <br />resolution for denial. <br />Exhibits <br />A — Draft IUP Approval Resolution <br />B — Notice of Council Action dated May 11, 2017 and May 24, 2017 <br />C — Draft Council Minutes of May 22, 2017 <br />Prepared By: J.
