M <br />ORONO REGULAR COUNCIL MEETING HELD OCTOBER 8, 1990 <br />NAVARRE HEIGHTS DRAINAGE CONTINUED <br />• before going to bids. There will be a public hearing for special <br />assessments before they are spread over the property. <br />Karen Cuff stated that she just found out the public hearing <br />held two weeks prior was a voluntary public hearing and not the <br />statute project hearing. It was never conveyed to her. <br />Acting Mayor Callahan responded that staff intended and <br />Council thought they were having the right kind of hearing. <br />Because there was an error in the notice, legally it wasn't. <br />Bernhardson stated they felt it was a public hearing that <br />was not required. <br />Goetten asked if the people who did not get a chance to <br />speak at the last hearing because of the time difference need to <br />have another time to speak before the required public hearing. <br />Bernhardson stated that is why they are having another <br />opportunity at an informal hearing. On Ocbober 22nd this issue <br />will be an agenda item. Then a notice will be sent out to <br />people, not posted in the paper. <br />A motion was made by Acting Mayor Callahan, seconded by <br />• Goetten, to allow residents to present their thoughts and <br />concerns regarding the Navarre Heights Drainage on October 22, <br />1990 prior to anything further being done on this project and <br />another public hearing shall be scheduled at the time of plans <br />and bids. Motion, Ayes -4, Nays -0. Motion passed. <br />Ms. Cuff stated that she wanted to be sure that there will <br />be a statute public hearing so this will not come back to her <br />again at some point in time. <br />HIGHWAY 12 CORRIDOR <br />This was an informational item. <br />A motion was made by Acting Mayor Callahan, seconded by <br />Councilmember Nettles, to accept the Highway 12 Corridor <br />information. Motion, Ayes -4, Nays -0. Motion passed. <br />RULES OF CRIMINAL PROCEDURE CHANGE* <br />RESOLUTION #2886 <br />It was moved by Goetten, seconded by Peterson, that Council <br />adopt Resolution #2886, indicating their desire not to have the <br />proposed rules of criminal procedure change made effective <br />January 1, 1991. Motion, Ayes -4, Nays -0. Motion passed. <br />BICYCLE DISPOSITION* <br />It was moved by Goetten, seconded by Peterson, that Council <br />40 revise its direction of the August 23, 1990 meeting and that the <br />bicycles will be disposed of by an individual for possible <br />salvage and recycling.
