' <br /> Hennepin County Special Requirements Section 00800 - SUPPI.EMENARY CONDIT'IONS <br /> 1/2/02 Edition , <br /> Page Z 7 of 32 <br /> The successful contractor shall require all subcontractors to submit a , <br /> Contractor/Subcontractor Certification to the contractor before beginning work on the <br /> project site, and the contractor shall in turn submit the form to the Prevailing Wage � <br /> Compliance Specialist prior to said work. <br /> The contractor shall require all subcontractors to maintain and preserve payrolls and basic <br /> records. Such payrolls and records shall contain the pertinent information required to be , <br /> contained in contractor's payrolls and basic records. The contractor shall require all <br /> subcontractors to submit to the contractor their pertinent payrolls so as to a11ow the <br /> contractor to submit to the Prevailing Wage Compliance Specialist, within the fourteen , <br /> calendar day time frame, said payrolls and contractor's payrolls pertaining to the same <br /> weekly pay period. The contractor shall also require its subcontractors to promptly submit � <br /> their basic records to the contractor upon its request. <br /> Each payroll submitted shall be accompanied by a statement (i.e., Statement of Compliance) <br /> signed by the contractor or subcontractor or his or her agent who pays or supervises the 1 <br /> payment of the persons employed under the contract and shall certify the following: <br /> .1 That the payroll period conta.ins all required information and that such information is , <br /> correct and complete; <br /> .2 That each laborer, worker, or mechanic (including apprentices) employed on the , <br /> contract during the payroll period has been paid the full weekly wages earned, <br /> without rebate, kickback, or refund either directly or indirectly, and that no <br /> deductions have been made either directly or indirectly from the full wages eamed � <br /> (other than permissible deductions);and <br /> .3 That each laborer, worker, or mechanic has been paid not less than the applicable ' <br /> wage rate and fringe benefits or cash equivalent for the classification of work <br /> performed, as specified in the apphcable Wage Determma.tion mcorporated into the <br /> contract. , <br /> The falsification of any of the above certifications may subject the contractor or <br /> subcontractor to any remedies available to the County whether under these specifications, <br /> law, statute, ordinance, rule, regulation and/or equity, including — without limitation ' <br /> whatsoever—liquidated damages in the amount set forth herein. <br /> Supplementary to, and not in limitation of, any other record provision contained in the ' <br /> contract documents, the contractor and/or any subcontractor shall promptly make the <br /> records required under the labor standards clauses of the contract available for inspection, <br /> copying, or transcription by representatives of Hennepin County, and/or MN DOLI, and , <br /> sha.11 permit such representatives to interview employees during working hours on the job. <br /> The contractor shall be as fully responsible for the acts and omissions of its subcontractors <br /> and of persons either directly or indirectly employed by them, as for the acts or omissions , <br /> of persons directly employed by the contractor. <br /> Suppl Conds-27 ' <br /> HENNEPINCOiJNTY Orono Salt Storage <br /> March 22,2002 Project No.: 0031569 Contract No.: 0751R2 <br /> , <br />
