The Contractor must receive approval from the Hennepin County Project Manager � <br /> and Hennepin County's TCS before making substitution for, or deviation from any <br /> certified SBE firms offered in the original proposal, or if Contractor is under goal,any ' <br /> Subcontractors/Suppliers originally proposed. <br /> 5. The Contractor's commitment to a specified participation level is to meet the required � <br /> participation levels, and is not intended and shall not be used to discriminate against <br /> any qualified company or group of companies. <br /> 6. Only SBEs that are recognized as certified by the Hennepin County SBE Program will , <br /> be considered eligiblefor inclusion in the Contractor's goals. <br /> 7. Hennepin County's TCS will make the final deternunation with regards to SBE � <br /> compliance of proposals received. Contract TCS at (612) 348-5960 with any <br /> questions regarding SBE certification or SBE participation compliance. � <br /> 8. With notification that a Contractor is the Apparent Low Bidder(s), they will be <br /> required to submit a Hennepin County SBE Program Prime Contractor's Participation ' <br /> Form, and Subcontractor's Participation Form (if applicable) to Hennepin County <br /> Purchasing listing the Subcontractors that they will have on the job and indicating the <br /> contract amount of each, etc., per the form. This list sha.11 indicate the � <br /> Subcontractors/Suppliers that comprise the Bidder's SBE participarion and will <br /> become part of the Contract. If any Bidder is unable to meet the SBE required <br /> participarion levels,it shall submit a detailed statement of its good-faith efforts. The � <br /> good-faith effort statement shall identify all efforts made prior and subsequent to Bid <br /> Opening to achieve the desired result. Failure to meet either the required SBE ' <br /> participation levels or demonstrate sufficient good-faith efforts may be cause to deem <br /> a Bidder non-responsive. <br /> 9. The Hennepin County Project Manager will review the Subcontractors listed by ' <br /> Prime Contractors to ascertain whether the Subcontractors in question are capa.ble and <br /> have the capacity to provide the work noted. <br /> 13.9.3 CONTRACTOR/SUBCONTRACTOR REPORTING REQUIItEMENTS ' <br /> Contractors, as required in Article 13 of Section 00120. Supplementarv Instructions to ' <br /> Bi.dders. shall submit SBE Partici�tion Reports to TCS indicating their total contract valu�e <br /> and the breakdown of all self-performed and subcontracted work—including both certified ' <br /> SBEs and non-SBEs. The report shall detail each subcontract by labor, material and <br /> subcontracts of all tiers, which shall be sunilazly detailed.
