For purposes <br /> thereof, the term prevailing wage rate is defined as that amount required to be paid for a <br /> classification of work which is equal to the sum of the basic hourly rate plus applica.ble <br /> , fringe benefits as noted in the Wage Rate Determination of the Minnesota Department of <br /> Labor and Industry (NIl�1 DOLI) for Commercial Construction Within Hennepin County <br /> (hereinafter referred to as the Wage Determination). Said Wage Determination is attached <br /> ' hereto and made a part hereof, and the work class�cations therein shall govern irrespective <br /> of the terms of any contractual and/or employee/employer relationship which may be <br /> alleged to eaust between the contractor and such laborers, workers, and mechanics. All <br /> ' laborers, workers, and mechanics sha.11 be paid the appropriate prevailing wage for the <br /> classifica.tion of work actually performed, without regard to skill, except as provided in <br /> ' subparagraph 13.10.5., APPRENTICES. In detemvning the appropriate work <br /> classification,Hennepin County will look at area practice (construction customs and usag�e <br /> common witlun Hennepm County). <br /> ' During the period from the time an hourly employee is required to report for duty at the site <br /> of work until such time that he/she is released or permitted to leave the site of work, no <br /> deduction shall be made from his/her rime for any delays of less than thirty consecutive <br /> ' minutes. <br /> A contractor or subcontractor may discharge his/her prevailing wage rate obligation as <br /> defined above by (1) making cash payments to the employee plus payments to an <br /> � employee's fringe benefit program (funded or unfunded), the sum of which is equal to the <br /> total prevailing wage rate; or (2) maldng payments in cash to the employee in the amount <br /> , equal to the total prevailing wage rate.
