' <br /> Hennepin County Spexial Requirements Section 00800 - SUPPLEMENARY CONDITIONS <br /> ' 1/2/02 Edition <br /> Page Z of 32 <br /> ' Add the following to Article 2: <br /> 2.5 OWNER'S RIGHT TO AUDIT BOOKS AND RECORDS. <br /> , 2.5.1 The Contractor agrees that the County, the State Auditor, the Legislative Auditor and/or <br /> any of their duly authorized representatives shall at any time during normal business hours, <br /> ' and as often as they may reasonably deem necessary, have access to and the right to <br /> examine,excerpt,and transcribe any books, documents,papers, records, etc., which involve <br /> transactions relating to this Agreement. Such material must be retained by the Contractor <br /> ' for the longer of(1) six years after Final Payment; or (2) such additional period as may be <br /> necessary to comply with specific Contract Conditions (incli�ding without limitation any <br /> period covered by a written warranty). The Contractor's accounring practices and <br /> ' procedures relevant to this Contract shall also be subject to examinationby any of aforesaid <br /> persons as often as and during such times as aforesaid. <br /> ' 3.4 LABOR AND MATERTAIS <br /> , Add the following to Subparagraph 3.4.1: <br /> Should the Contract Documents require work to be performed after regular working hours or <br /> should the Contractor elect to perform work after regular worki.ng hours, the additional cost <br /> � of such work shall be bome by the Contractor. <br /> Add the following subparagraphs: <br /> ' 3.4.3 The Contractor shall be responsible for the costs of additional work and changes required to <br /> incorporate substitute materials,products or equipment approved during the bidding period <br /> ' into the Project. <br /> 3.4.4 After award of the Contract, a request for substitution of a material, product or piece of <br /> � equipment at no change in the Contract Sum will not be approved by the Owner or the <br /> Architect, unless the specified item is no longer manufactured, the specified item is <br /> unavailable as a result of an act of government(such as declaration of a national emergency), <br /> ' or delivery of the specified items is substantially delayed as a result of labor disputes <br /> affecting the manufacturer, unusual delay in transportation, or any other cause beyond <br /> control of the Contractor or a Subcontractor or material supplier which the Architect <br /> ' determines justifies the delay. Requests will not be approved where the delay in delivery <br /> results from failure to promptly place subcontracts and material orders.
