. .
Mike Gaffron
From: Mike Gaffron
Sent: Wednesday, April 16, 2014 9:23 AM
To: 'steveo@wooddalebuilders.com'
Cc: Melanie Curtis; Lyle Oman; Christine Mattson
Subject: FW: 2524/2526 Sandstone Lane
Attachments: Survey Excerpt- Plan View of Buffer Encroachment.pdf; Covenant Excerpts re Allowable
Encroachment of Commons.pdf; Wetland Buffer Declaration.pdf; Side Elevation Depicting
Buffer Encroachment.pdf
Steve-
We have a small issue with the proposed plans for these two homes. First, the submitted survey correctly notes that the
35' MCWD buffer boundary coincides with the rear lot line of both lots. It then shows that the proposed porch extends
over the rear lot line by one foot. A closer look at the building elevation plans indicates that this is a roofed screen
porch, with its rear wall extending one foot over the lot line, and its roof extending 2 feet over the line.
The allowed encroachments of commons area do not allow for this magnitude of new construction encroaching into the
commons area by design, only in error. The only allowed encroachments by design are:
1) a roof overhang encroachment of 36 inches;
2) a box window encroachment of 18 inches; and
3) a deck overhang encroachment of 30 inches
The proposed screen porch is not a deck. We have denied covered porch encroachments of the commons area in
Stonebay previously.
Additionally, the porch and roof encroachments as shown are encroachments into the MCWD buffer. The buffer
declaration between MCWD and the Stonebay Association indicate that no structure that would "impede the function of
the buffer" is allowed. Our past experience has been that any structure above the defined buffer area is not allowed by
MCWD.
It would appear the simple solution to this is to reduce the depth of the screen porches so that no portion of their walls
or roof extend past the rear lot line. Other solutions would include decreasing the overall length of the house so that
there is no overlap of porch or porch roof into the 35' wetland buffer.
See the attachments. Please call or email if you have questions. We will need a revised set of plans and a revised survey
in order to continue our review.
Mike
Michael P.Gaffron
Assistant City Administrator/Long Term Strategy
City of Orono
(Street Address)2750 Kelley Parkway
(Mailing Address) P.O.Box 66,Crysta) Bay,MN 55323
Phone:(952)249-4600
Fax: (952)249-4616
1
