First, the submitted survey correctly notes that the <br /> 35' MCWD buffer boundary coincides with the rear lot line of both lots. It then shows that the proposed porch extends <br /> over the rear lot line by one foot. A closer look at the building elevation plans indicates that this is a roofed screen <br /> porch, with its rear wall extending one foot over the lot line, and its roof extending 2 feet over the line. <br /> The allowed encroachments of commons area do not allow for this magnitude of new construction encroaching into the <br /> commons area by design, only in error. The only allowed encroachments by design are: <br /> 1) a roof overhang encroachment of 36 inches; <br /> 2) a box window encroachment of 18 inches; and <br /> 3) a deck overhang encroachment of 30 inches <br /> The proposed screen porch is not a deck. We have denied covered porch encroachments of the commons area in <br /> Stonebay previously. <br /> Additionally,the porch and roof encroachments as shown are encroachments into the MCWD buffer. The buffer <br /> declaration between MCWD and the Stonebay Association indicate that no structure that would "impede the function of <br /> the buffer" is allowed. Our past experience has been that any structure above the defined buffer area is not allowed by <br /> MCWD. <br /> It would appear the simple solution to this is to reduce the depth of the screen porches so that no portion of their walls <br /> or roof extend past the rear lot line. Other solutions would include decreasing the overall length of the house so that <br /> there is no overlap of porch or porch roof into the 35' wetland buffer. <br /> See the attachments.
