The lot is only 80' long. Based on this, the proposed screen porch extends 4' past the rear lot line, <br /> while the survey indicates only a 2-foot encroachment over the line. The survey and plans don't match. Either way, this <br /> magnitude of encroachment is not allowed.The same issue, but to a lesser magnitude, is also apparent in the right hand <br /> unit, Lot 20,which on the plans is dimensioned at 82'within an 80' deep lot. <br /> The allowed encroachments of commons area do not allow for this magnitude of new construction encroaching into the <br /> commons area by design, only in error. The only allowed encroachments by design are: <br /> 1) a roof overhang encroachment of 36 inches; <br /> 2) a box window encroachment of 18 inches; and <br /> 3) a deck overhang encroachment of 30 inches <br /> The proposed screen porches are not decks. We have denied covered porch encroachments in the commons area in <br /> Stonebay in the past, including the units you built last summer. <br /> It would appear the simple solution to this is to reduce the depth of the screen porches so that no portions of their walls <br /> extend past the rear lot line. Other solutions would include decreasing the overall length of the units so that there is no <br /> overlap of porch structure. The porch roof is allowed to encroach as much as 36' past the rear lot line, but not the porch <br /> itself. <br /> Please call or email if you have questions.
