Date: February 28, 2007 <br /> Re: Wetland Ordinance - Confirmation of Compliance <br /> Remarks: <br /> Project Background: The proposed project involves the redevelopment of an existing lot that includes the <br /> construction of a new home and associated structures and driveways at 360 North Arm Lane. This project <br /> triggers the wetland buffer ordinance as a result of removal of the principal use of more than 50% of the existing <br /> homes market value and reconstructed on the same property. The wetland on this property is adjacent to an <br /> existing channel that provides access to North Arm Lake. In part due to the property draining ultimately to the <br /> channel and North Arm Lake which is a recreational resource the wetland was classified by the watershed <br /> district as preserve. Under the City's wetland ordinance this classification requires the widest buffer width, 50 ft, <br /> of native vegetation which provides valuable filtering and removal of nutrients from the proposed lawn area and <br /> impervious surfaces prior to reaching to the wetland as well as the lake. <br /> Wetland Ordinance Compliance Review <br /> Currently there is an existing home, driveway, and docks approved under previous permits. Due to the existing <br /> docks and current turf grass access to the docks the applicant has provided an alternative layout of the buffer to <br /> maintain the dock access and the immediate recreational space adjacent to the docks and is requesting this <br /> flexibility on the buffer layout (buffer averaging) based on Section 78-1608 (Buffer Flexibility) of the Wetland <br /> Ordinance. In these locations the buffer width is reduced from 50 feet to 15 to 5 feet. <br /> The applicant has proposed to shift 5,500 square of the buffer away from the docks for access and expand the <br /> buffer directly to the east of the proposed home by 2,500 square feet (additional 20 feet approx.) and directly to <br /> the south of the proposed home by 3000 square feet (additional 30 feet approx.) for a total of 5,500 square feet. <br /> The relocation of the buffer east of the proposed structure will create a total buffer width of 70 —85 feet and is <br /> located in an area that provides additional buffering from the lawn and will serve to expand the habitat of the <br /> buffer. The buffer expansion along the south of the property will provide buffer and habitat to an existing <br /> wetland located south of this property.
