Additionally, we received a sketch with a description of the plan for reduction of the take
access stair.Thank you for submitting this information.
In May, the CEty received a revised survey dated May 13, 2011 and a sketch modifying the existing fire ring area
within 75-feet of the lake and discussed this plan with your contractor Benjamin Schmid. Schmid was informed
that the City could not approve the plans for the modifications to the fire ring patio area as the existing fire ring
patio area is considered illegal/unpermitted hardcover within the 75-foot lake setback area. While you are allowed
a 4-foot wide lake access stair within the 75-foot setback no other hardcover is permitted in this area. The fire ring
,,, itself may remain, however the stone patio surrounding the fire ring must be removed as it is considered illegal
hardcover.
Further, the survey and hardcover calculation worksheets submitted reflect improvements to the property within
the 0-75' zone resulting in 6% hardcover without the proper City approval. Hardcover levels in this zone which
exceed the allowed 4-foot wide stair(and walkway to the dock)are illegal and must be removed.
We understand that you continue to make unpermitted improvements to the property and most recently on May
25th our inspector observed work being conducted on a deck without permits. Please be advised permits are
required prior to commencing all construction projects, grading, or other activity.
We will issue the after-the-fact Zoning Permit 2010-01207 for the modification of the lakeside deck and lake
access stair according to the plans submitted by Auben Residential on June 2. No escrow will be required. In
conjunction with Zoning Permit 2010-01207 please remove all of the illegal hardcover from within the 0-75 foot
zone by or before July 1, 2011 in order to avoid further enforcement action by the City.
If you have any questions, you can contact me at mcurtis[aci.orono.mn.us or 952.249.4627.
Sincerely,
CITY OF ORONO
t
lGt-
Melanie Curtis
Planning and Zoning Coordinator
Telephone(952)249-4600 •Fax(952}249-4616
www.ci.orono.mn.us
