Groves, Jr. (hereinafter "the applicant”) is <br /> the owner of the property located at 215 Hollander Road within the City of <br /> Orono (hereinafter "City") and legally described as follows: <br /> That part of Lot 3, Block 1, HOLLY ACRES 2ND ADDITION, according to <br /> the recorded plat thereof, lying Westerly of a line and its Northerly <br /> extension drawn from a point on the Northeasterly line of said Lot 3, <br /> distant 231.37 feet Northwest of the Northeast corner of said Lot 3 to <br /> a point on the South line of said Lot 3 distant 182.00 feet West of <br /> the Southeast corner thereof; and <br /> That part of Lot 4, Block l, HOLLY ACRES 2ND ADDITION, according to <br /> the recorded plat thereof , lying Southerly of a line drawn <br /> • Northwesterly from the Southeast corner of said Lot 4 to a point on <br /> the Northwesterly line of said Lot 4 , distant 231.69 feet <br /> • Southwesterly of the Northwest corner thereof; all in Hennepin County, <br /> Minnesota (hereinafter "property"); and <br /> WHEREAS, the applicant has applied to the City of Orono for a <br /> Conditional Use Permit to permit placement of up to 1,000 cubic yards of <br /> fill per Municipal Zoning Code Section 10.03, Subdivision 19. <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br /> Minnesota: <br /> FINDINGS <br /> f l. This application was reviewed a's Zoning File #1159. <br /> 2. The property is located in the RR-1B Single Family Rural <br /> , Residential Zoning District. <br /> 3. On June 15, 1987, the Orono Planning Commission reviewed the <br /> application as proposed and recommended approval, finding that the <br /> proposed fill within the front yard area is solely for the purpose of <br /> leveling the yard to make it more maintainable, and that the proposed <br /> changes in grade will have no detrimental effect on drainage patterns <br /> in the neighborhood, and will have no detrimental effect on the <br /> quality or quantity of run-off from the property. � <br /> • 4.
