The City Council has considered this application including the <br /> findings and recommendations of the Planning Commission, reports by <br /> staff and comments of the applicant and the effect of the proposed use <br /> on the health, safety and welfare of the community. <br /> 6. The City Council finds that granting a Conditional Use Permit to <br /> allow the proposed placement of fill will not be detrimental to the <br /> health, safety or general welfare of the public, would not adversely <br /> affect light, air nor pose a fire hazard or other danger to <br /> neighboring properties, nor will it depreciate surrounding property <br /> values and that the proposed level of use of the property will be in <br /> keeping with the intent and objectives of the Zoning Code and <br /> Comprehensive Plan of the City. <br /> CONCLOSIONS, ORDER AND CONDITIONS <br /> Based upon one or more of the above findings, the Orono City <br /> Council hereby grants a Conditional Use Permit per Municipal Zoning Code <br /> • Section 10.03, Subdivision 19 to permit the placement of up to 1,000 cubic <br /> yards of fill material in the front yard of the property, subject to the <br /> following conditions: <br /> 1. Applicant shall maintain appropriate erosion controls as may be <br /> required by the City during the grading process. <br /> 4 <br /> 2. All disturbed areas shall be immediately seeded (or sodded if <br /> applicant desires) upon completion of the grading work. <br /> 3. Applicant is advised that no more than 8" of additional fill <br /> should be placed over the drainfield area; and all work in that area <br /> should be done using tracked equipment with a low compaction <br /> potential. <br /> � 4. Applicant or his contractor shall obtain the appropriate grading <br /> permit prior to commencement of the project ($100.50 per current fee <br /> schedule) . <br /> 5. Applicant is advised to work with the Hollander Road homeowners <br /> regarding truck ingress and egress over the private roadway. <br /> 6. Violation of or non-compliance with any of the terms and condi- <br /> tions of this resolution shall constitute a violation of the zoning <br /> code, shal 1 automatically terminate any authority granted herein, and <br />, shal 1 be punishable as a misdemeanor. <br />� • 7.
