'1 C� � � <br /> A RESOLUTION GR.ANTING VARIAIVCES <br /> TO MUNICIPAL ZONING CODE <br /> SECTIONS 78-1288 AND 78-1438 <br /> FILE NO. 07-3285 <br /> WHEREAS, Robbin S. Johnson and B. Kristine Johnson, husband and <br /> wife, (hereinafter "Owners") are the owners of the property located at 1280 Bracketts Point <br /> Road within the City of Orono (hereinafter "City") and legally described as: See Exhibit A <br /> (hereinafter "the property"); and <br /> WHEREAS, the Owners have made application to the City for a Variance to <br /> Municipal Zoning Code Section 78-1288 to allow hardcover in the 0 to 75 foot zone when no <br /> hardcover is allowed; and <br /> WHEREAS, the Owners have made application to the City for a variance to <br /> Municipal Zoning Code Section 78-1438 to allow a pool house/storage building four feet <br /> fi•om the swimming pool when a ten foot separation is required; and <br /> WHEREAS, after due published notice and mailed notice in accordance with <br /> Minnesota Statutes and the City of Orono Zoning and Planning Cades, tlle Orano Plan;�:ng <br /> Commission held a public hearing on Apri? 15, 2007, at which tir.mes a?1 persons desiring to be <br /> heard concerning this application were given the opportunity to speak thereon. <br /> NOW, THEREFORE, BE IT RESOY�VED by the City Council of Orono, <br /> Minnesota: <br /> �INDIN�S <br /> 1. This application was reviewed as Zonin� File#07-3285 <br /> 2. The property is located in the LR-lA zoning district, where 2 acres is the <br /> minimum lot area and 200 feet is the minimum lot width. The property is <br /> approximately 1.80 acres in area and 300 feet in width. <br /> 3. The Plaruiin� Commission reviewed this application on April 16, 2007 and on <br /> a vote of 6 - 0 recommended approval of the variances, based on the follo���in� <br /> findings: <br /> Pa,e 1 of� <br />
