The hardcover that will remain in the 0 to 75 foot zone is a corner of the <br /> pool and a walkway between doors on the lake side of the house. This <br /> hardcover was shown on the original building permit plan as being outside <br /> the 0 to 75 foot zone <br /> b. The amount of hardcover allowed to remain in the 0 to 75 foot zone will be <br /> subtracted from the hardcover allowed in the 75 to 250 foot zone. <br /> c. The property has poor soils so the house, pool and pool equipment vault <br /> are on pilings. The location on top of the pool equipment vault will allow <br /> use of the pilings to support the proposed building. <br /> d. The wetland between the street and the pool precludes placement of the <br /> building between the pool and the street. � <br /> e. The pool equipment vault is four feet high. If the proposed building were <br /> placed ten feet from the pool the pool equipment vault would be between <br /> the building and the pool and would block the view of the pool from the <br /> pool house. <br /> f. The Owners have agreed to modify the proposed building to make it more <br /> difficult far someone to dive from its roof into the pool. <br /> 4. The City Council has considered this application including the findings and <br /> recommendation of the Planning Commission, reports by City staff, comments <br /> by the applicants and the public, and the effect of the proposed variance on the <br /> health, safety and welfare of the community. ' - <br /> 5. The City Council finds that the conditions existing on this property are peculiar <br /> to it and do not apply generally to other property in this zoning district; that <br /> grantin� the variances would not adversely afiect traffic conditions, light, air <br /> nor pose a tire hazard or otner dan;er to neignnoring property; wouid not <br /> merely serve as a convenience to the Owners, but are necessary to alleviate a <br /> demonstrable hardship or difficulty; are necessary to preserve a substantial <br /> property right of the applicants; and would be in keeping with the spirit and <br /> intent of the Zonin� Code and Comprehensive Plan of the City. <br /> Page2of5 <br />
