VILLAGE OF ORONO <br />Regular Fleeting of the Planning Commission. <br />June S, 1972 <br />Tae Planning Commission met on the above date <br />witii the following members present; Chairman <br />Poisson, Gasch, Herfurth, Kullberg, Searles, <br />Southwortli, and Van Nest. Absent: Elliott, <br />Hays, Nicholls, and Ryerse. <br />G <br />Gasch moved, Southworth seconded, that the <br />ninutes of the meeting of May 15, 1972, be <br />approved. Motion, Ayes (7) - Nays (0). <br />Richard Schieffer represented Howard Eisinger <br />in an application for a variance from Municipal <br />Ordinance NO. 125, for purposes of conducting <br />a landfill operation using dirt, rock and <br />construction materials. He pointed out that <br />Mr. Eisinger was a legal non>conforming use <br />and tliat he recognized it was necessary to <br />get tite Village approval and obtain a license. <br />He was of tae opinion that Ordinance NO. 125 <br />was a rather vaguely drawn ordinance much <br />like many obscenity and vagrancy ordinances, <br />iic tnougat the Mills' report was more of a <br />study on the speed of the runoff through <br />the various culverts controlling the creek <br />running through the property than an adverse <br />report on the proposed landfill operation. <br />Van Nest interspersed at this time that <br />the Minnehaha Creek Watershed District had <br />definitely taken a stand against tne use of <br />the property as a landfill. Searles stated <br />tae use of tne property throughout the years <br />was unique and had carried certain privileges <br />in its usage not common to ot.ier properties <br />so tliat removing these privileges was not <br />removing a right common to other properties. <br />Mr. Schieffer countered that many variances <br />have been granted in the Village and that <br />variances always grant privileges. ?!r. <br />Dale Palmatier from the Minnehaha Creek <br />Watcrsiied District spoke briefly saying <br />tne reason for the board's negative decision <br />was because the site is a drainage collection <br />basin for a very large area and the creek <br />flowing tnrough it runs directly to Lake <br />Minnetonka. Their concern was that there <br />would be a contamination of the creek and <br />also the ground water. Fir. Gene Hiclcock, <br />also of the Minnehaha Creek Watershed District, <br />used as an example the old Johnson Street <br />landfill in Minneapolis where the city had <br />dumped old buildings from urban renewal <br />projects.
