CITY of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. ______ _ <br />A RESOLUTION DENYING <br />A CONDITIONAL USE PERMIT <br />PER MUNICIPAL ZONING CODE <br />SECTION 10.03, SUBDIVISION 21 (2) (C) <br />FILE #2290 <br />WHEREAS, the City of Orono is a municipal corporation organized and existing <br />under the laws of the State of Minnesota; and <br />WHEREAS, pursuant to State Statutes 412 et. seq. and 462 et. seq., the City Council <br />of the City of Orono has adopted zoning regulations for the protection of the public health, safety <br />and general welfare; and <br />WHEREAS, Steve and Elaine Silus (hereinafter "the applicants") are the property <br />owners of3235 Casco Circle within the City of Orono (hereinafter "the City") and legally described <br />as follows: <br />Lot 19, Spring Park, also all that part of vacated Lakeshore Avenue and of the tract ofland <br />lying between said vacated avenue and Lake Minnetonka which lie between the easterly <br />extensions of the northerly and southerly lines of said Lot 19; and (hereinafter "the <br />property"); and <br />WHEREAS, the applicant has applied to the City for a conditional use permit per <br />Municipal Zoning Code Section 10.03, Subdivision 21 (2) (C) to permit grading within 5' of the <br />southerly property line to allow for a driveway and retaining wall to be located 2' from the property <br />line; and <br />WHEREAS, the Orono Planning Commission after due public notice held a public <br />hearing on January 20, 1998, to review the application, at which time the applicant, and all other <br />interested members of the public were allowed to comment on the proposed application; and <br />Page 1 of 3
