A preliminary review indicates the following revisions and <br /> submittals must be made in order to continue review of the permit: <br /> • The City adopted a new wetland ordinance on August 22, 2005 that requires new <br /> development to install buffers and maintain setbacks from, the required buffer, all <br /> dependent of wetland type. As this permit application was received after the <br /> ordinance was adopted and formally published, development of this lot must meet the <br /> new wetland regulations. There exist two .wetland bodies on this property both <br /> classified as "Preserve" wetlands requiring a 50' buffer and a 20' setback from that <br /> buffer. Based on those requirements it appears that the proposed house location will <br /> have to shift approximately 20' south and the grading for the walk-out may have to be <br /> revised so that the 50' buffer remains undisturbed. Grading may occur within the 20' <br /> setback from the buffer but not within the buffer. The buffer and buffer setback <br /> requirement from the wetland to the south appears to work and exceptions will be <br /> made to allow for the driveway crossing. Implementation of 50' buffers must be <br /> included in the plan for both wetland bodies. I've enclosed the new ordinance <br /> language for your review. <br /> • Submittal of MCWD permit allowing for the driveway crossing. <br /> • The proposed septic design and sites do not match the septic design and sites that <br /> were approved with the subdivision. The design submitted for the new sites show site <br /> locations that differ from the locations shown on the survey. If the approved septic <br /> sites are not going to be used, then the proposed sites need to be shown on contour <br /> and that they meet all the following required setbacks: <br /> o 75' from wetland edge <br /> o 20' from property line <br /> o 20' from driveway and any other hardcover or structures <br /> o 20' from septic tanks <br /> Telephone(952)249-4600 © Fax (952) 249-4616 <br /> ww•w.ci.orono.enn.us <br />
