� � <br /> � O _V <br /> O � O <br /> - �g CITY of ORONO <br /> � � <br /> �� ���{'' G~' RESOLUTION OF THE CITY COUNCIL <br /> L`�kEsKog'� No. 5 7 5 3 . <br /> A RESOLUTION GRANTING PRELIMINARY <br /> APPROVAL OF A CLASS III SUBDIVISION FOR <br /> PROPERTY LOCATED AT 60 STUBBS BAY ROAD SOUTH <br /> FILE NO. 08-3355 <br /> WHEREAS, Clement Kroll and Winnifred Kroll, husband and wife, ("the <br /> Owners") are the owners of property legally described as Lot 1, Block 2, Betz Addition, <br /> Hennepin County, Minnesota("the Property"); and <br /> WHEREAS, Tim Hauser ("the Applicant") on April l, 2008, filed a formal <br /> subdivision application with the City for approval of a four lot residential plat of the <br /> Property; and <br /> WHEREAS, after due published and mailed notice in accordance with Minnesota <br /> Statutes 462.35$ et. seq. and the City of Orono's Zoning and Subdivision Codes, the <br /> Orono Planning Commission held a public hearing on April 21, 2008, at which time all <br /> persons desiring to be heard concerning this application were given the opportunity to <br /> speak thereon; and <br /> WHEREAS, at their regular meeting held on May 12, 2008 the Orono City <br /> Council considered the subdivision application of the Applicant noting the following <br /> findings of fact: <br /> 1. The Property contains a total of approximately 8.9 acres of land. <br /> 2. None of the Property is delineated wetland but some of the Property may fall <br /> within the required buffer for a wetland on adjacent property. <br /> 3. The property is located within the RR-1B One Family Rural Residential zoning <br /> district requiring a minimum of 2 acres of contiguous dry buildable land within <br /> each newly created building lot. <br /> 4. The proposed plat consists of four residential lots, each meeting the minimum lot <br /> standard requirements of the RR-1B, One Family Rural Residential zoning <br /> district. <br /> 5. A single family residence currently exists within proposed Lot 1. The subdivision <br /> of the property would not create any violations of zoning code regulations for this <br /> house.
