�o� <br /> 0 0 <br /> CITY of ORONO <br /> ,� , �, <br /> ti <br /> ��� �G~' RESOLUTION OF THE CITY COUNCIL <br /> `9kEgI30'g' No. 5 9 1 6 <br /> NOW, THEREFORE BE IT RESOLVED by the City Council of Orono, <br /> Minnesota: <br /> FINDINGS <br /> l. This application was reviewed as Zoning File 10-3443. <br /> 2. The property is located in the LR-1B One Family Lakeshore Residential Zoning <br /> District which requires a minimum lot area of 1.0 acre and a minimum lot width <br /> of 140'. <br /> 3. The Planning Commission reviewed this application at a public hearing held on <br /> January 19, 2010 and with a vote of 5 — 1 recommended approval of variances <br /> based on the following findings: <br /> a. The property contains 39,138 square feet in area or 0.89 acre and has 58 feet <br /> of width at the OHWL and 145 feet of width at the 75-foot setback. The <br /> property is situated at the northwest end of the inlet/lagoon which results in a <br /> narrow lakeshore. <br /> b. The property is consistent in size with the other properties in the immediate <br /> neighborhood. <br /> c. The proposed home is outside of the average lakeshore setback. <br /> d. Moving the house further out of the 75-foot setback would significantly limit <br /> lake views. <br /> e. The applicants will grant an easement to the City for the existing drainage <br /> swale which cuts through the property. <br /> f. The applicants have proposed vegetative buffers along the drainage swale and <br /> shoreline to mitigate for the requested excess hardcover. <br /> g. The proposed home complies with the building height and structural coverage <br /> limitations and will be compatible with the immediate neighborhood. <br /> h. The existing driveway access off of Shadywood Road will be abandoned and <br /> a new access from Pheasant Road will be created. <br /> Page 2 of 5 <br />
