�o� <br /> 0 0 <br /> CITY of ORONO <br /> ,� �, � <br /> ti <br /> ti <br /> RESOLUTION OF THE CITY COUNCIL <br /> ��`9k'ESH.�g'�G NO. � � 1 � <br /> A RESOLUTION GRANTING VARIANCES <br /> TO MUNICIPAL ZONING CODE <br /> SECTIONS 78-330, 78-1279 & 78-1288 <br /> FILE NO. 10-3443 <br /> WHEREAS, Timothy Hadden and Juliann Hadden, husband and wife <br /> (hereinafter "the applicants") are the owners of the property located at 2655 Shadywood Road <br /> within the City of Orono (hereinafter the"City") and legally described as follows: <br /> That part of Lots 22 and 23, "Pheasant Lawn" lying northerly of a straight line drawn from a <br /> point in the southeasterly line of said Lot 22, distant 27 feet southwesterly of, measured along <br /> said southeasterly line of said Lot 22 from the northeasterly corner of said Lot 22 to a point in <br /> the northwesterly line of Lot 23, "Pheasant Lawn", distant 30 feet northeasterly of, measured <br /> along said northwesterly line of said Lot 23 from the most westerly corner of said Lot 23, <br /> Hennepin County, Minnesota(hereinafter the"property"); and <br /> WHEREAS, the applicants have made application to the City of Orono for a <br /> variance to Orono Municipal Zoning Code Section 78-330 to allow redevelopment of a property <br /> 58 feet in width at the ordinary high water level (OHWL) and 145 feet at the 75-foot setback <br /> where a 140 foot width is required for both; and <br /> WHEREAS, the applicants have made application to the City of Orono for a <br /> variance to Orono Municipal Zoning Code Section 78-1279 to allow construction of a new <br /> residence 48 feet from the OHWL for the house and 35 feet from the OHWL for an above grade <br /> deck where a 75-foot setback is normally required; and <br /> WHEREAS, the applicants have made application to the City of Orono for a <br /> variance to Orono Municipal Zoning Code Section 78-1288 to allow 25% hardcover within the <br /> 0-75 foot zone where 0% is normally allowed in conjunction with construction of the new <br /> residence; and <br /> WHEREAS, after due published notice and mailed notice in accordance with <br /> Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning <br /> Commission held a public hearing on January 19, 2410, at which times all persons desiring to be <br /> heard concerning this application were given the opportunity to speak thereon. <br /> Page 1 of 5 <br />
