Council approval is based on the site pla�i and building plans submitted by the <br /> applicants aiid a►uiotated by City staff, attached to this Resolution as E:chibit A. <br /> Any amendments to said plans which are not in conformity with City codes or <br /> with this approval will require fitrther Plamiing Commission and City Council <br /> review. <br /> 2. Hardcover in the 0-75' zone shall not be increased above the current level of 153 <br /> s.f. or 4.2%. Hardcover in the 75'-250' zone shall be reduced to and remain no <br /> greater than 3,372 s.f. or 33.6%, and hardcover in the 250-500' zone shall be <br /> reduced to and remain no greater than 1,534 s.f. or 48.6%, per the proposed plan <br /> and hardcover allowance summary as depicted on Exhibit A. Applicants are <br /> a�lvised that any future requests to increase hardcover or change the nature of <br /> approved hardcover shall require City approval, and increases in hardcover will <br /> not likely be approved without concunent reduction in existinJ hardcover. <br /> 3. Applicants shall remove all plastic or fabric liner material, if any, from the <br /> decorative landscape beds on the property to ensure their permeability as non- <br /> hardcover surfaces. <br /> 4. Required removals of hardcover shall be completed prior to the first inspection for <br /> the proposed addition. <br /> S. The applicants shall be subject to the recommendations of the City Engineer as <br /> noted in Tom Kellogg's letter of October 16, 2006. The �vest or rear foundation <br /> wall of the garage shall be extended downward to a depth that eliminates any need <br /> for a retaining wall along that 5' setback which �vill allow for the approved <br /> grading plan to be accomplished. <br /> 6. Authorities granted by this variance approval run �vith the property not with the <br /> applicants, but are pemlissive only and must be exercised by application for a <br /> building pern�it �vithin one year of the date of Council approval, or these variances � <br /> will expire on that date (October 23, 2007). <br /> 7. Violation of or non-compliance with any of the tenns and conditions of this <br /> a�proval shall constitute a violation of the zoning code, shall automatically <br /> terminate any authority granted herein, and shall be punishable as a misdemeanor. <br /> PaQe 4 of 7 <br />
