Accardiizg to Heiuiepin County plat maps and the survey submitted with <br /> the application, there is a portion of Forest Lane (undeveloped) located <br /> between this property aizd the lakeshore. It is assumed that this poi-tion of <br /> Forest Lane will be combined witli tl�.e applicants' property at soine time <br /> in the future. It has served as the lakeshore access for this lot. Other lots in <br /> the neighborhood have had Forest Lane vacated and a few lots have <br /> comUined that portion of property with the residential site. For current <br /> zoning purposes, this lot is Ueing considered a lalceshore lot for setback <br /> purposes even though the legal description and property records do not <br /> include the vacated portion of the road, This is an importaut distinction <br /> for this property because a non-lakeshore lot would not permit an <br /> accessory building to be located closer to the street than the house, <br /> 4. The City Council finds that the conditions existing on this property are peculiar to <br /> it aild do not apply generally to other property in this zoning district; that granting <br /> the variances will not adversely affect traffic conditions, light, air, nor pose a fire <br /> hazard or other danger to neighboring property; would not merely serve as a <br /> convenience to the applicants, but is necessary to alleviate a demonstrable <br /> hardship or difficulty; is necessary to preserve a substantial property right of the <br /> applicauts; and would be in keeping with the spirit and intent of the Zoning Code <br /> and Comprehensive Plan of the City. <br /> 5. The City Cotulcil has considered this application including the findings and <br /> recorruzlendations of the Plamling Commission, reports by City Staff, comments <br /> by the applicants and th� effect of the proposed variance on the health, safety and <br /> rvelfare of the conununity. <br /> CONCILUSIONS, O1�ER, ANI) CONDITIONS <br /> Based upon one or more of the above findings, the Orono City Council hereby <br /> �rants variances to Municipal Zoning Code Section 78-1288 to pennit 3,372 s.f. (33.6%) <br /> hardcover in the 75-250' lakeshore setback zone tivhere 3,812 s.f. (37.9%) exists and 2,512.5 s.f, <br /> (25%) is allowed; to perniit 1,534 s.f. (48.6%) hardcover in the 250-SUO' lalceshore setbacic <br /> wh�re 1,607 s.f. (50.9%) e�cists and 946.5 s.f.
