The use of your <br /> property by residents of Eastlake Street is a problem that <br /> apparently goes back many years, and it may be difficult for you <br /> to ultimately resolve. <br /> I understand that you have discussed trespass laws and their <br /> enforcement with Police Chief Melvin Kilbo. I have incorporated <br /> his comments regarding trespass below. <br /> Regarding the possibility of construction of a fence, a <br /> number of criteria apply: <br /> 1. No fence is al lowed to be constructed within the City's <br /> Conservation and Flowage Easement, described as the drainage <br /> easement in the western triangular area of your property <br /> (see attached plat) . <br /> 2. No fence can be constructed within 75' of the normal <br /> shoreline of the lake (elevation 929. 4 ' ) . <br /> 3. The flood plain and wetlands ordinance also technical ly <br /> requires a 26' setback from the creek for any fence or other <br /> construction (see code sections attached). <br /> 4. The fence must be within your property boundaries. <br /> 5. The fence may not extend past the "average lakeshore <br /> setback line" which is defined as a line between the <br /> adjacent lakeshore properties on either side of you. <br /> 6.
