NO. 4 9 11.i: ?°d <br /> variance to Municipal Zoning Code Section 10.03,Subdivision 15(C)to permit a 7'monument and <br /> gate at the driveway entrance to be constructed within the 50' front yard street setback where a <br /> monument and gate of 3 V2 feet is allowed. Approval is subject to the following conditions: <br /> 1. Maximum height of the entrance monuments shall be 7', per the proposed plan <br /> shown in Exhibit B. Any changes will require further Council review. <br /> 2. Any lighting associated with the structure shall be directed downward so that the <br /> source of light is not directly visible from neighboring properties. <br /> 3. Authorities granted by this variance run with the property not with the applicant,but <br /> are permissive only and must be exercised by application for a building permit within <br /> one year of the date of Council approval, or these variances will expire on that date <br /> (April 14, 2004). <br /> 4. Violation of or non-compliance with any of the terms and conditions of this variance <br /> shall constitute a violation of the zoning code, shall automatically terminate any <br /> authority granted herein, and shall be punishable as a misdemeanor. <br /> 5.
