0 0 CITY of ORONO 6 RESOLUTION OF THE CITY COUNCIL 4. The Planning Commission made the following findings of fact: A. The proposed structure includes entry monument and gate on either side of the driveway entrance to the property. B. The proposed monument and gate structure at the drive entrance will allow adequate width for emergency vehicles access. C. The entrance monuments and gates are in character with the neighborhood. D. The property is in an area where the general development is consistent with other properties in the locality. The relationship of the property is unique because of the property being 21.4 acres in size. E. The hardship that supports the variance includes the need for security and limitation of foot and automobile traffic onto the private property. The height variance is necessary to allow construction of a structure of a size and scale to be a deterrent in itself. 5. The City Council finds that the conditions existing on this property are peculiar to it and do not apply generally to other property in this zoning district; that granting the variances will not adversely affect traffic conditions,light,air,nor pose a fire hazard or other danger to neighboring property;would not merely serve as a convenience to the applicant, but is necessary to alleviate a demonstrable hardship or difficulty; is necessary to preserve a substantial property right of the applicant; and would be in keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the City. 6. The City Council has considered this application including the findings and recommendations of the Planning Commission, reports by City Staff, comments by the applicant and the effect of the proposed variances on the health, safety and welfare of the community. CONCLUSIONS, ORDER, AND CONDITIONS Based upon one or more of the above findings, the Orono City Council hereby grants a Page 2 of 5
