The City Council has considered this application <br /> including the findings and recommendations of the Planning <br /> Commission, reports by City staff , comments by the <br /> applicants and the effect of the after-the-fact variance on <br /> the health, safety and welfare of the community. <br /> CONCLUSIONS, ORDER AND CONDITIONS <br /> Based upon one or more of the findings noted above, the <br /> Orono City Council hereby grants a variance to Municipal Zoning <br /> Code Section 10.23, Subdivision 6 (B) to permit the construction <br /> of an 18'x22' addition to the north or rear side of the existing <br /> residence and per Section 10.22, Subdivision 1 (B) grants a <br /> variance to the average lakeshore setback as portions of addition <br /> will be located in front of the average lakeshore setback line. <br /> Approval is subject to the following conditions: <br /> 1. Applicants are placed on notice that if loft area is <br /> converted to a legal bedroom, the septic system shall be re- <br /> evaluated at the time of such improvement. <br /> 2. Authorities granted by this resolution run with the <br /> property not with the applicants, but are permissive only <br /> and must be exercised by application for a building permit <br /> within orae year of the date of Council approval , or this <br /> variance will expire on that date (April 22, 1992). <br /> 3. Violation of or non-compliance with any of the terms and <br /> conditions of this variance shall constitute a violation of <br /> the zoning code, shall automatically terminate any authority <br /> granted herein, and shall be punishable as a misdemeanor. <br /> 4. The undersigned applicants have read, understood and <br /> hereby agree to the terms of this resolution and on behalf <br /> of themselves, their heirs, successors and assigns, hereby <br /> agree to the recording of this resolution in the chin of <br /> title of the property. <br /> Page 3 of 5 <br /> L. . <br /> • <br />
