4LOA CITY OF ORONO <br /> RESOLUTION OF THE CITY COUNCIL <br /> NO. <br /> 6857 <br /> -fKESHG0. <br /> 1. The Developer has proposed a building envelope area on the plat drawing to reflect <br /> their desired encroachment. The home would be permitted as close as 80 feet from the <br /> ordinary high water level. The orientation of the Dayton home to the east is facing mostly <br /> directly south and east and is such that no views of the lake will be impacted by the location <br /> of a home on Lot 1. The home at 3051 Farview Lane has no lake views over this Lot 1 <br /> due to the existing trees and topography as well as their own home's orientation to lake <br /> which are primarily western views. <br /> 13. The Park Fee is determined as 8% of the fair market value of the land being subdivided, <br /> but must be between a minimum of $3,250 and a maximum of $5,550 per residential <br /> dwelling unit. For the proposed development, the Park Fee would be based only on the <br /> new lot. The City will confirm the park dedication required at the time of final plat. <br /> The Parks, Trails and Open Space element of the Orono Community Management Plan <br /> (CMP) has plans for trails that may specifically require dedication of land from the <br /> Property. To accommodate a future trail, a 10' wide trail easement along the Old Crystal <br /> Bay Road frontage should be granted as part of the plat as suggested by the Parks <br /> Commission. A 33-foot right-of-way dedication to Hennepin County is shown along Old <br /> Crystal Bay Road South. <br /> 14. The Owners have submitted a Conservation Design Report prepared by Jacobson <br /> Environmental which inventories and describes the environmental features of the site, <br /> defining what natural values of the site should be preserved or enhanced and how that <br /> should occur. <br /> 15. According to the Jacobson Report, the Developer will be implementing a 20-foot wide no- <br /> cut buffer along all proposed lot lines (10-feet on either side of the interior lot lines within <br /> the plat) to preserve the existing trees for screening. Significant trees may only be cut if <br /> they are diseased or damaged, and will be replaced at a 2:1 ratio. The Jacobson Report <br /> states that reed canary grass was identified within the wetland basins on proposed Lot 2; <br /> no management is proposed. <br /> CONCLUSIONS, ORDER AND CONDITIONS: <br /> NOW, THEREFORE, BE IT RESOLVED, based upon one or more of the above findings, <br /> the Orono City Council hereby grants Preliminary Plat Approval to allow the subdivision of the <br /> Property into 2 building lots and one outlot, with an established building pad location 80 feet from <br /> the ordinary high water level, lakeward of the average lakeshore setback line for Lot 1, as depicted <br /> on the preliminary plat drawing and grading plan dated 02/21/18 prepared by Gronberg and <br /> Associates, attached as Exhibit A, subject to the following conditions: <br /> 5 <br />
