CITY OF ORONO <br /> iLOAt <br /> RESOLUTION OF THE CITY COUNCIL <br /> 1*ILG NO. 6857 <br /> .kESHO�� <br /> WHEREAS, on April 9, 2018, the City Council reviewed the application and the <br /> recommendations of the Planning Commission and City staff; and <br /> WHEREAS, the City Council reviewed the proposal at a regular meeting held on <br /> April 9, 2018, and hereby made the following findings with regards to this application: <br /> FINDINGS OF FACT: <br /> 1. This application was reviewed as Zoning File #LA18-000022. The analysis contained <br /> within staff memos and the exhibits attached to the aforesaid memos, all minutes from the <br /> above mentioned meetings, and any and all other materials distributed at these meetings <br /> are hereby incorporated by reference. <br /> 2. The Property is guided for Low Density Residential in the 2030 Community Management <br /> Plan. <br /> 3. The Property is located in the LR-1A One Family Lakeshore Residential Zoning District <br /> which requires a minimum of 2.0 acres and 200 feet of width; the Property contains 20.58 <br /> acres in area and has a defined lot width of over 700 feet at the lakeshore. <br /> 4. The Property is located within the Metropolitan Urban Service Area (MUSA). Sewer is <br /> available to the Property in Old Crystal Bay Road South. City Code (Sec. 82-224) requires <br /> the connection to sewer where available, however the Developer has asked for a waiver <br /> of this requirement until such time when the Property is further developed. They have <br /> provided acceptable septic system designs for the new Lot 1 as well as a new alternate <br /> site for the existing home on Lot 2. The City Council has the authority to deviate from the <br /> sewer connection requirement if they determine there are extraordinary conditions. <br /> 5. The Developer proposes that both lots be served by private septic systems and private <br /> wells for the following reasons: <br /> a. Ample Areas for Placement of Septic Sites. Because of the large lot size, the areas <br /> available for the placement of septic systems are also large. Nothing must be <br /> shoehorned in to fit the lots. <br /> b. Sewer Line Length. To connect to the public sewer system lying along Old Crystal <br /> Bay Road, would require an extraordinarily long sewer line connection. The <br /> connecting line, from Old Crystal Bay Road to the easterly line of the westerly lot <br /> would be approximately 1,000 feet. That is an extraordinary distance for a <br /> connecting sewer line. Then, after running westerly approximately 1,000 feet, the <br /> 3 <br />
