(�,� DEC 3 0 2011 '.x:� ', <br /> TV%%A%%`! gi* ITY of ORONO <br /> ��^ ti- • G~ RESOLUTION OF THE CITY COUNCIL <br /> +l�kEs'xog�v <br /> NO. 6 0 6 9 <br /> A RESOLUTION GRANTING <br /> PRELIMINARY PLAT APPROVAL, <br /> APPROVING VACATION OF EASMENTS AND <br /> APPROVING THE FINAL PLAT OF <br /> CRYSTAL BAY BUSINESS CENTER 2" ADDITION <br /> FILE#11-3513 <br /> WHEREAS, the City of Orono is a municipal corporation organized and existing <br /> under the laws of the State of Minnesota; and <br /> • <br /> • <br /> WHEREAS, the City Council of the City of Orono (hereinafter"City Council") has <br /> adopted subdivision and land development regulations for the orderly, economic and safe <br /> development of land within the City; and <br /> WHEREAS, the City Council has considered the application by Ryan Companies <br /> US Inc., a Minnesota corporation (hereinafter"Developer"), for subdivision of properties located <br /> at 450 Old Crystal Bay Road North and 550 Old Crystal Bay Road North and legally described <br /> as: Lot 1 and Lot 2, Block 2, Crystal Bay Business Center, Hennepin County, Minnesota <br /> (hereinafter"the Property"); and . <br /> • <br /> WHEREAS, on June 21, 2011, the Developer filed a complete subdivision <br /> application with the City for approval of a two-lot commercial re-plat of the Property; and <br /> WHEREAS, after due published and mailed notice in accordance with Minnesota <br /> Statutes 462.358 et. seq. and the City of Orono Zoning and Subdivision Codes, on July 18, <br /> 2011, the'Orono Planning Commission held a public hearing for the application at which time all <br /> persons desiring to be heard concerning the application were given the opportunity to speak <br /> thereon; and <br /> WHEREAS, after due published and mailed notice in accordance with Minnesota <br /> Statutes 462.358 et. seq. and the City of Orono Zoning and Planning Codes, the Orono <br /> Planning Commission held a public hearing on the proposed vacations at a regular meeting <br /> held on July 18, 2011 and in consideration of the following findings the Planning Commission <br /> finds the vacation as proposed is in keeping with the public interest: <br /> 1. The gas, electric, telephone and cable companies have consented to the vacation. <br /> 2. The City Engineer finds the vacation acceptable. <br /> 3.
