1 0 <br /> O O <br /> CITY of ORONO <br /> "* 4 f4 RESOLUTION OF THE CITY COUNCIL <br /> 0%.4`9kEs-tow NO. 5 7 1 5 <br /> A RESOLUTION GRANTING PRELIMINARY <br /> APPROVAL OF A CLASS II SUBDIVISION AND OF A PLANNED RESIDENTAL <br /> DEVELOPMENT FOR <br /> PROPERTY LOCATED AT 2940 SIXTH AVENUE NORTH <br /> FILE NO. 07-3332 <br /> WHEREAS, on October 16, 2007, acting on behalf of Stonegate Farm, Inc., PRC <br /> Development Company, (hereinafter the "Developer") filed an application with the City for <br /> approval of a six unit Planned Residential Development on property legally described attached <br /> as: <br /> That part of the East Half of the Southwest Quarter of Section 28, Township 118, <br /> Range 23, Hennepin County, Minnesota, lying north of the centerline of County <br /> Road No. 6 as monumented and platted in the plat of Hennepin County State Aid <br /> Highway Number 6, Plat 5, Hennepin County Minnesota, according to the <br /> Government Survey thereof. The north, east, and west boundary lines of said <br /> tract have been marked by Judicial Landmarks set pursuant to Torrens Cases Nos. <br /> 17158 and 18135 <br /> (hereinafter"the Property"); and <br /> WHEREAS, on October 16, 2007, acting on behalf of Stonegate Farm, Inc., the <br /> Developer also filed a subdivision application with the City for approval of the plat of the <br /> Property to correspond to the proposed Planned Residential Development. <br /> WHEREAS, after due published and mailed notice in accordance with Minnesota <br /> Statutes 462.358 et. seq. and the City of Orono's Zoning and Subdivision Codes, the Orono <br /> Planning Commission held a public hearing on November 19, 2007, at which time all persons <br /> desiring to be heard concerning this application were given the opportunity to speak thereon; and <br /> WHEREAS, at their regular meeting held on December 10, 2007, the Orono City <br /> Council considered the applications of the Developer noting the following findings of fact: <br /> 1. The property is located within the RR-1B One Family Rural Residential Zoning District <br /> requiring a minimum of two acres of contiguous dry buildable land within each newly <br /> created building lot. <br /> 2. The property contains a total of approximately 24.63 acres of land; approximately 14 <br /> acres of which is delineated wetland. <br /> Page 1 of 5 <br />
